Description
The National Institute of Standards and Technology (NIST) in Gaithersburg, Maryland intends to negotiate and award a purchase order using simplified acquisition procedures on a sole source basis under the authority of FAR 13.106(b)(1), with Janis Research Company, Inc. in Wilmington, MA for the repair and upgrade of existing Top-Loading Closed-Cycle Refrigerator System (TLCCR) Sample Positioners, including retrofitting a Safety Venting System. The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500. The purpose of this procurement is to retrofit an additional safety feature into the existing fleet of top-loading closed-cycle refrigerators manufactured by Janis Research Company, Inc. Janis Research Company, Inc. made the top-loading closed-cycle refrigerators (TLCCR) that are the subject of the retrofitting in this procurement. These TLCCR's are custom-designed by Janis to NIST's specifications for use in neutron scattering experiments. A safety venting system for the sample well was developed by NIST in collaboration with Janis Research Company, Inc. The system was tested by NIST and shown to work properly. Janis Research has since informed all of its customers using their TLCCR's, either standard or custom design, of the potential for projectile ejection of the sample positioned under certain circumstances. This safety venting system prevents this possibility. Janis Research Company, Inc. is including this feature in all its new products, and offering this safety upgrade retrofit to its current customers as an additional cost option. Choosing to purchase this upgrade with any other source would lead to concerns about ultimate responsibility for design and specifications, and liability in the case of defective workmanship. No solicitation package will be issued. This notice of intent is not a request for competitive quotations, however, responses received by September 7, 2010 will be considered by the Government. A determination by the Government whether to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
