Description
Title: BRAND NAME Deep Exploration Software and Maintenance This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. In accordance with FAR Subpart 19.2 it is the policy of the Government to provide maximum practicable opportunities in the acquisition for small business concerns. In accordance with FAR Subpart 19.5, this acquisition has been exclusively set aside for participation by small business concerns. The North American Industry Classification System (NAICS) code for this acquisition is 541519 with a small business size standard of 1,000 employees. The requirement is for the following Deep Exploration items: Part number: DE-CAD6.0-N-ESD-PRP, Qty: 8, Deep Exploration CAD Ed. Floating Licenses Perpetual; Part number: CAD6.0-N-ESD-PRP Maint., Qty: 8, Deep Exploration CAD Ed. Floating Annual Maintenance. The reference number for this Request for Quote (RFQ) is 8G60152AS011. BRAND NAME JUSTIFICATION: NGA has a requirement for the brand name software licenses and annual software maintenance coverage as outlined above. All of the products referenced in this posting are proprietary products of Right Hemisphere. NGA is expanding an existing system that currently utilizes Deep Exploration software and no other brand of software will seamlessly integrate into NGA's existing system. The Deep Exploration software and maintenance is the only software and maintenance that fulfills the form, fit, and function requirements of the NGA at this time. Period of performance for software maintenance is expected to be approximately 5 Sep 2010 through 4 Sep 2011. Please respond as soon as possible but no later than 1:00 pm Central, August 27, 2010. The delivery is to be made to: NGA Navy Yard Attn: Keith Burgess MS N-24 1200 First Street SE Washington DC 20303-0001 Only Authorized Deep Exploration resellers will be considered. Delivery is FOB Destination. Total cost shall also include any shipping and handling. The Government reserves the right to cancel this solicitation, with no obligation to the vendor by the Government. Vendors must be approved and registered in CCR (www.ccr.gov) before award can be made. Clauses and Provisions: The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-44. The provision at FAR 52.212-1 Instructions to Offerors-Commercial Items applies to this acquisition; only one award will be made to the lowest price offeror who meets the requirements for all line items. Offerors are required to submit a completed copy of FAR 52.212-3 Offeror Representations and Certification--Commercial Items, with their offer; The clause at 52.212-4 Contract Terms and Conditions--Commercial Items, applies to this acquisition. Section 425, no person may, except with the written permission of the both the Secretary of Defense and the Director of Central Intelligence, knowingly use the words "National Geospatial-Intelligence Agency", "National Imagery and Mapping Agency" or "Defense Mapping Agency", the initials "NGA", "NIMA" or "DMA", the seal of the National Geospatial-Intelligence Agency, National Imagery and Mapping Agency, or the Defense Mapping Agency, or any colorable imitation of such words, initials, or seal in connection with any merchandise, retail product, impersonation, solicitation, or commercial activity in a manner reasonably calculated to convey the impression that such use is approved, endorsed, or authorized by both the Secretary of Defense and the Director of Central Intelligence. Whenever it appears to the U. S. Attorney General that any person is engaged or about to engage in an act or practice which constitutes or will constitute conduct prohibited by paragraph (a), the Attorney General may initiate a civil proceeding in a district court of the United States to enjoin such act or practice. Such court shall proceed as soon as practicable to hearing and determination of such action and may, at any time before final determination, enter restraining orders or prohibitions, or take such other action as is warranted, to prevent injury to the United States, or to any person or class of persons for whose protection the action is brought. NGA 5X252.204-7000-90 PUBLIC RELEASE OF INFORMATION (APR 2004) Information pertaining to this contract shall not be released to the public except as authorized by the Contracting Officer in accordance with DFARS 252.204-7000, Disclosure of Information. Requests for approval to release information pertaining to this contract shall be submitted to the Contracting Officer by means of NGA Form 5230-1, National Geospatial-Intelligence Agency Request for Clearance for Public Release. NGA 5X52.227-9000 Activities that Affect US Persons. This contract is sponsored by the National Geospatial Intelligence Agency. All work and services to be performed hereunder shall be in strict compliance with procedures contained in DOD 5240.1-R.
