Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center 5000 W National Avenue Bldg 5, Milwaukee WI 53295 2.Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the acquisition of a construction contract to provide code compliance for the fire pump in building 111 at the Clement J. Zablocki VA Medical Center, Milwaukee, Wisconsin.. 3.A description of supplies/services required: Furnish all labor, material, equipment and qualified supervision to ensure code compliance for the fire pump in building 111 to be connected to the supply side of the (two) service disconnects and the stand by emergency generator power supply, reporting instruments, & FA software for buildings 111 to comply with current NEC & NFPA 2009 requirements as shown in the engineering drawing and specifications.. 4.Statutory authority permitting other than full and open competition: Information Letter 049-07-08, Public Law 109-461 and FAR 6.302-5, Authorized or Required by Statute. 5.Facilities Unique Qualifications: None 6.Efforts made to ensure that offers are solicited from as many potential sources as is practicable: Not Applicable. 7.Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The anticipated award price of the contract between $250,000 and $500,000 will exceed the simplified acquisition threshold (as defined in section 4 of the Office of federal Procurement Policy Act (41 U.S.C. 403); and in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers the best value to the United States. Also, the contractor is currently mobilized on-site with another project, which will reduce costs. 8.Market survey conducted: The concern Stokes Webb, LLC. Is a Service Disabled Veteran Owned Small Business registered in the Vendor Information Pages (VIP) database, available at www.VetBiz.gov. A review of Stokes Webb, LLC; capability/profile information revealed that they have the experience, expertise and bonding level to perform the scope of work outlined in this project. Stokes Webb, LLC is determined to be a responsible source with respect to performance of such contract opportunity. Stokes Webb, LLC meets the requirements under Public Law 109-461, which gives the contracting officer authority to sole-source procurements to SDVOSB contractors. 9.Other facts: None 10.Other sources expressing an interest: Not Applicable at this time 11.Actions to remove or overcome any barriers to competition: Not Applicable at this time 12.Certification: I certify that this justification is accurate and complete to the best of my knowledge. //S// Rich Hedman Contract Specialist, VAGLAC
