- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1.Identification of the Agency and the Contracting Activity: Department of Veterans Affairs, Great Lakes Acquisition Center 5000 W National Avenue Bldg 5, Milwaukee WI 53295 2.Nature and/or description of the action being approved: Justification and approval for other than full and open competition for the acquisition of a construction contract to provide code compliance for the Emergency Generator, Alternate Panel project at the Clement J. Zablocki VA Medical Center, Milwaukee, Wisconsin. 3.A description of supplies/services required: Furnish all labor, material, equipment and qualified supervision to complete upgrades to electrical switchgear. Work includes three Tasks related to electrical switchgear performance under emergency situations: 1. Alternate power hookup in case of failure of existing emergency generators. 2.Circuit breakers (2) for complete isolation of ties between switchgear 1 & 2, and switchgear 3 & 4. 3.JCAHO Reporting functions for metering and trending software on electrical system. 4.Statutory authority permitting other than full and open competition: Information Letter 049-07-08, Public Law 109-461 and FAR 6.302-5, Authorized or Required by Statute. 5.Facilities Unique Qualifications: None 6.Efforts made to ensure that offers are solicited from as many potential sources as is practicable: Not Applicable. 7.Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The anticipated award price of the contract between $250,000 and $500,000 will exceed the simplified acquisition threshold (as defined in section 4 of the Office of federal Procurement Policy Act (41 U.S.C. 403); and in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers the best value to the United States. Also, the contractor is currently engaged as the prime contractor on the medical center's Main Switchboard Replacement project, which is directly related to this project. Because they are currently mobilized on site, costs for mobilization should be reduced or eliminated. 8.Market survey conducted: The concern JEN-KPH is a Service Disabled Veteran Owned Small Business registered in the Vendor Information Pages (VIP) database, available at www.VetBiz.gov. A review of JEN-KPH; capability/profile information revealed that they have the experience, expertise and bonding level to perform the scope of work outlined in this project. JEN-KPH is determined to be a responsible source with respect to performance of such contract opportunity.
