- This is a Notice of Proposed Contract Action Synopsis. This proposed contract action is published to notify potential sources that the Department of Veterans Affairs intends to award a sole source, firm fixed price contract under the authority of FAR 6.302-1 (Other than Full & Open Competition) to Johnson Controls Incorporated located at 11500 Metric Drive Boulevard, Austin, Texas, 78758-4043. The award is to provide all labor, materials, tools and equipment, and Design-Build services necessary to Upgrade and Reconfigure a Cooling Tower at the VA Medical Center located in Temple, TX. The term of this contract will be for a base year period. The Applicable NAICS Code is 238220 and applicable size standard is $13.5 million. This is not a request for competitive quotes, but responses received on or before August 27, 2010 will be evaluated. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Respondents will not be notified of the Government ™s determination. The Government will not pay for any information that is submitted by respondents to this notice of proposed contract action.
