- Description
- The Uniformed Services University of the Health Sciences (USUHS), Bethesda, MD has a requirement for an annual laboratory instrument maintenance services contract. USUHS intends to negotiate on a sole source basis under the authority of FAR 13.106-1(b)(1) with BD Biosciences, San Jose, CA for the service and maintenance on the: 1. Facsaria 3 Laser System Customer Material No.: 335223 Serial No.: P22300039 (Coverage includes the BD Facsaria Flow Cytometer with 3 lasers one computer workstation) 2. LSRII Special (No Lasers) Customer Material No.: 340551 Serial No.: H47100085 (Coverage includes the BD LSR II Special Order System with one computer workstation) 3. Laser Sapphire 488-20 Blue Customer Material No.: 334495 Serial No.: No-Serial-3516 4. Laser Cube 405-50C Violet Customer Material No. : 345198 Serial No.: NO-SERIAL-3518 5. Hene Laser Customer Material No.: 342353 Serial No.: No-Serial-3517 Services are being procured as a commercial item in accordance with the procedures in FAR Part 12, Acquisition of Commercial Items, and FAR Part 13, Simplified Acquisition Procedures. In accordance with FAR Part 13.106-1(b(1), Soliciting from a single source, for purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. The systems are highly specialized in design and application requiring software and firmware updates and system component upgrades that are proprietary to BD Biosciences. BD Biosciences the manufacturer is the only company that has the specialized and technical knowledge as well as necessary tools, manpower and repair parts to maintain these pieces of equipment in an operable state. The contractor will provide all labor, parts, materials, tools, transportation and management necessary to maintain and repair the BD Biosciences systems in strict accordance with the Original Equipment Manufacturer (OEM) service specifications to include software revisions and two preventive maintenance during the 12 month period. The contractor will provide technical support, application support, and operational assistance to Government personnel via phone and on-site assistance. This is not a request for quotes and a solicitation package will not be issued. Any response received to this notice will be used in determining whether to conduct a competitive procurement. A determination by the government not to compete this action will be based on responses received and is solely within the discretion of the government.
