Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 5, Washington, D.C. Medical Center (688). 2.Description of Action: Requesting sole source procurement to provide construction for a Women s Health Pavilion to medical attention for female veterans specialized medical concerns. The work will be completed by Patriot Construction, LLC a Service-Disabled Veteran-Owned Small Business. 3.Description of Supplies or Services: A proposed construction contract consists of completely preparing a portion of the VAMC for women health visits. Contractor will conduct demolition and removal of existing structures and furnish labor and materials necessary to provide a renovated area that is expanded suitable for a women's health and wellness program. 4.Statutory Authority: 38 U.S.C. 8127(c) ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement (X) (5) Authorized or Required by Statute; 38 U.S.C. 8127(c) ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: It has been determined that a sole source Service Disabled Veteran Owned Small Business award be made to Patriot Construction, LLC in accordance with 38 U.S.C. 8127(c). The intent of this contract is for the Department of Veterans Affair to care for its female veteran population in a manner deserving of their service as opposed to farming parts of their specialize care to nearby hospitals. Currently the VA utilizes Medical Sharing Agreements with hospitals such as The Washington Hospital Center, George Washington University Medical Center, and Howard University. We pay these hospitals for services that we are unable to conduct due to our limitations to centralize unique services for women as compared to our majority male population. Although these hospitals are well known for their services, they lack the capabilities to fully understand veterans and particularly female veterans psychological and mental needs compared to a VA medical facility. For this reason alone, VA hospitals were established to service veterans and their families. The Washington, D.C. Medical Center for the Women s Health Pavilion is scheduled as a stand-alone department within the VAMC facility. Veteran Affair leaders and congress members have recognized an increase in the need to address specific medical concerns for female veterans and have authorized VA facilities to address these concerns and needs. The Washington, DC area services a large population of women veterans as reported by the Department of Veterans Affairs Center for Women Veterans. Patriot Construction, LLC is currently under contract at this facility completing a construction project in the area close to where the Women s Health Pavilion is scheduled to be located. The contracting officer has validated that the contract is listed in Vendor Information Pages (VIP) data base and qualifies as small in accordance with the federal small business size standards for the applicable North American Industry Classification System (NAICS) code assigned to this procurement 6.Actions to Promote Competition: This VISN has met or exceeded its requirements to award to SDVOSB businesses and has demonstrated more than a willingness to seek competition when available. However, this solicitation justifies a need due to unusual circumstances as specified in IL 049-07-08 and FAR Subpart 6.303-2(b)(2). 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $ 2,239,000.00 for renovation and expansion of an area of the Washington, DC VAMC. I consider the price for the project to be fair and reasonable based on the type of work required 8.Market Survey (FAR 10): Please refer to Section 5. 9.Other Considerations: Other competitive options were considered and determined to not satisfy the needs for this solicitation. Full and open and set-aside competition would be lengthy after it was determined that a negotiated procedure is better suited for the Women s Health Pavilion project. 10.Listing of Sources that expressed, in writing, an interest in the acquisition: No additional sources were contacted to provide proposals due to the urgent and compelling nature of this requirement. 11.Statement of Actions to Overcome Barriers to Competition: The life quality urgency for the Women s Health Pavilion project cannot be further delayed with open competition.
