- This is a notice of intent to award a sole source contract and is not a request for competitive proposals. The government intends to solicit a proposal and enter into a contract with VETERANS' GROUP LLC, 3450 SACRAMENTO ST STE 222, SAN FRANCISCO CA 94118-1914 a small business concern, to provide a Phantom MILPRO Sportjon boat for Yukon Charlie/Gates of the Arctic National Park & Preserve. Please see the below Justification for other than Full and Open Competition for further details. This notice of intent is not a request for competitive proposals. However, the Government shall consider all responses received prior to the close date of this announcement. Written responses to this notice shall contain sufficient documentation to establish bonafide capability to fulfill the requirement. A solicitation is not available. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (or SOLE SOURCE) Background: 1. FAR Statutory Authority cited: 6.302, Circumstances Permitting Other Than Full and Open Competition. Per FAR 6.302-1(a)(i)(B) the only vendor able to provide the required boat is Phantom Milpro. Research shows that only one vendor can construct and deliver a boat with required necessary safety and reliability standards. The Phantom MILPRO Sport Jon is a 21 foot, 200 Horse Power, inboard jet-propelled watercraft that is capable of hauling over 4500lbs of cargo. 2. Nature and description of the supplies or services required to meet the agency's needs.21' aluminum Phantom Sportjon powered by Mercury Optimax Sportjet inboard motor, customized to NPS needs for use in Yukon Charlie/Gates of the Arctic National Park for various uses. 3. A demonstration that the proposed contractor is the only source available to provide these services or goods (i.e. unique qualifications, proprietary rights etc.). Phantom Milpro is the only vendor capable of providing the required craft due to the loading capacity needed for the park. The Phantom has an overall capacity of 4500lbs compared to competitiors that are only rated at 1800lbs. Given the remoteness of operations and the need for maximum safety, performance, handling, and reliability, it is important that the builder of this vessel is reputable and has a proven history of building quality boats of this configuration. 4. A description of the market research that was conducted and the results, or a statement of the reason a market research was not conducted: We contacted three reputable vendors that have recently delivered aluminum boats of this size, class, and purpose to agency and private commercial buyers for use in Alaska waters: Compeau's, North River/Almar, and Alumacraft. Compeau's stated that the SeaArk SJK series has a hardened hull and has a 200hp inboard motor, however the hauling capacity is only 1800lbs and therefore does not meet the need. North River Boats does not have a boat that meets any of the specifications. The only vendor offering the required horsepower, hauling needs and hardened hull design is Phantom Sportjon. 5. Any other facts supporting the use of other than full and open competition: N/A 6. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
