- ***The National Institute of Standards and Technology (NIST), intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Horiba Jobin Yvon Inc. in Edison, NJ for the upgrade of an existing Horiba Fluorolog 3 instrument. ***Sole Source determination is based on NIST's requirement for an upgrade to an existing Horiba Fluorolog 3 instrument. The upgrade will enable the instrument's emission wavelength range to be expanded. In addition, polarizers will also be installed to allow excitation and emission to be tunably polarized at all wavelengths. Due to the proprietary nature of this instrument, no other vendor would be able to perform the upgrade. As a result, Horiba Jobin Yvon is uniquely qualified to satisfy the Government's requirement. ***Delivery shall be FOB Destination, Gaithersburg, MD, and shall be provided at the Contractor's standard delivery schedule.*** ***The North American Industry Classification System (NAICS) code for this acquisition is 334516, and the size standard is 500 employees.*** ***No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the Government will consider responses received by August 23, 2010.*** A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
