****THIS IS FOR INFORMATIONAL PURPOSES ONLY**** The Network Contracting Activity 8 anticipates the award of a firm-fixed-price contract. Contractor shall provide all labor, tools, materials, equipment, supervision, and incidentals to make minor roof repairs to VBA Building 46 at Bay Pines VBA Bay Pines, Fl. BAY PINES VBA IS AWARDING THIS REQUIREMENT AS A SOLE SOURCE SDVOSB TO Midwestern Construction Services 18505 DORMAN RD LITHIA FL 33547. The applicable North American Industry Classification (NAICS) code for this procurement is 238160 and the business size standard is $14.0 Million. The magnitude of construction for this requirement is between $25,000 and $100,000. The POC for this project is Thomas Lucas email: Thomas.Lucas@VA.gov DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, Network Contracting Activity 8. 2.Description of Action: This is a request for other than full and open competition for the procurement of roofing repairs. This contract will be with Midwestern Construction Services, a SDVOSB concern. 3.Description of Supplies or Services: The work will include repairs to the roof around the atrium skylight at the VBA building 47. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement (X) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: Authority found under Public Law 109-461, and VA Acquisition Circular 2008-01, 819.7007 Sole Source awards to service-disabled veteran-owned small business concerns. (a) A contracting officer may award contracts to SDVOSB concerns on a sole source basis provided: (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) The requirement is synopsized in accordance with FAR part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with respect to performance; and (4) Award can be made at a fair and reasonable price. (b) The contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer "The SDVOSB contractor has been determined to be responsible "The price is fair and reasonable based on comparison to the IGE and competitive pricing information. 6.Actions to Promote Competition: Based on Public Law 109-461 (b) No separate justification or determination and findings are required under this part to set aside a contract action for service-disabled veteran-owned small business concerns. 7.Determination of Fair and Reasonable Price: The price is fair and reasonable based on comparison to the IGE and competitive pricing information. 8.Market Survey (FAR 10): Multiple SDVOSBs exist in the market place.
