- Department of Memorandum Veterans Affairs Date: July 29, 2010 From: Doug Reed, VISN 5 Contract Specialist Subj: Justification & Approval, Quick Series Publications, Rural Health Program To: Contract File JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION: In accordance with FAR 6.303, justification and approval for other than full and open competition is hereby approved for the issuance of the contractual action described below using other than full and open competition pursuant to the authority cited herein. 1. CONTRACTING ACTIVITY: Department of Veterans Affairs Veterans Integrated Service Network (VISN) 5 849 International Drive, Suite 275 Linthicum, MD 21090 2. NATURE OF ACTION BEING APPROVED: This justification and approval is for the award of a sole source purchase order to QuickSeries Publishing for Quick Series Guides. These guides will be used for the Rural Health Program. 3. DESCRIPTION OF SERVICES AND SUPPLIES: The following Quick Series Guides will be purchased: "Post-Traumatic Stress Disorder for Service "VA-Benefits for Veterans and Dependents "Recovering from Traumatic Brain Injury "Women Veterans Health Services Total contract value is $21,240. 4. STATUTORY AUTHORITY: FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, Citations: 10 U.S.C. 2304(c)(1) or 41 U.S.C. 253(c)(1). 5. RATIONALE SUPPORTING USE OF AUTHORITY CITED ABOVE: All of Quick Series publications are identified with an International Standard Book Number (ISBN), are registered with the Library of Congress, and are protected under the "1976 Copyright Act" of the laws of the United States (Title 17, U.S. Code). It is therefore illegal for anyone to: "Reproduce the copyrighted work; "Prepare derivative works based on the copyrighted works "Distribute copies of the copyrighted works, without written consent by the owner of the copyright. These are the only guides available that will satisfy the needs of the Rural Health Program for distributing health information to rural veteran populations. 6. EFFORT TO SOLICIT POTENTIAL SOURCES: No effort was made to solicit potential sources. 7. DETERMINATION OF FAIR AND REASONABLE COST: The prices quoted by QuickSeries for the publications ($21,240) are GSA Schedule prices, which were determined to be fair and reasonable by GSA under GSA Contract No.: GS-02F-0276P. 8. MARKET RESEARCH: Market research was not conducted, as these are copyrighted publications. 9. ADDITIONAL SUPPORT: None. 10. OTHER INTERESTED SOURCES: N/A 11. FUTURE COMPETITIVE PLAN: N/A 12.
