- The Commodity Futures Trading Commission ('CFTC' or 'Commission') intends to procure the services of Anthony Lucarelli, on a sole source basis, for additional securities expertise and training services for CFTC's Division of Clearing and Intermediary Oversight ('DCIO'). The work to be performed is a follow-on to an existing contract with this individual. The new contemplated contract will have a period of performance of one (1) year and will have the primary purpose of enhancing the Financial and Operational Combined Uniform Single ('FOCUS') Report instruction manuals developed under the current contract. The instruction manuals cover dealing with the capital and balance sheet aspects of the operations of securities broker-dealers ('BDs'), and the securities customers' protection aspects. The enhancements to the manuals will include several section expansions and additions. The contractor will also be required to develop training materials and conduct training sessions to share knowledge related to futures commission merchants ('FCMs') and BDs with DCIO audit staff and additional Commission employees. The training will teach CFTC staff how to better analyze the financial condition of dual-registered FCM/BDs, to provide assessments of dual registered FCM/BD operations, and to provide consulting expertise to DCIO staff as needed. Prior to award of the current contract, CFTC issued a sources sought synopsis to determine whether other entities possessed the minimum capabilities to perform the work. No responses were received to the synopsis. Based on the procurement history of this requirement, and due to the unique qualifications of Anthony Lucarelli, CFTC believes that no other qualified source exists for this work. This notice does not constitute a solicitation for offers and, as such, no solicitation is available. However, the Government will consider responses from all responsible sources received by the date and time identified above. Written responses must include sufficient information to establish capability to fulfill the requirement. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source described in this notice, and such determination shall be made at the sole discretion of CFTC.
