- jUSTIFICATION & APPROVAL 1. Program Office: NHGRI 2. Project Officer: 3. Project Information: Atempo Licensing Title: Period of Performance: August 1, 2010- July 31, 2011 Requisition No. Proposed Contractor: Atempo America 4. Description of what is to be acquired and the Benefit received by the Government: The subject requisition is for the procurement of additional software licensing and maintenance for those liscensing. In support of this mission, NHGRI has deployed a wide-range of servers and desktops, including these MAC servers, laptops, and desktops. The MAC platform is running proprietary software that cannot be easily ported to other platforms, and are necessary to support the goals of the institute. To ensure the continued success of NHGRI, it is necessary to purchase the additional drives to expand the capabilities of our backups for our MAC platform. This maintenance renewal is necessary to provide and protect our data files on our Macintosh platform and scientific workstations. This service will also allow staff members to contact the manufacturer with technical issues and ensure that we have access to latest technology to protect our network environment from vulnerabilities. This maintenance service is not available through any other vendors. 5. Independent Government Estimate: 6. Specific, detailed explanation of why it is not feasible to obtain full and open competition. Sole Source Justification. The sole-source determination is based upon the fact that Atempo is currently providing licensing and maintenance service to NHGRI. Remaining with this vendor would maintain the continuity of ongoing research being conducted in various studies. Changing vendors at this time would jeopardize the investments already made by the Government. 7. Statutory Authority. Federal Acquisition Regulation (FAR) Subpart 13.106-1. (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization). No other requirement and/or type for supply or service will satisfy agency need. 8. Market research: The review of previous purchase orders for the identical requirement. 9.
