- 1. Program Office: NHGRI 2. Project Officer: 3. Project Information: Annual Site license of OpenEye products. Title: Period of Performance: 30 Days After Award Requisition No. Proposed Contractor: OpenEye Scientific Software 4. Description of what is to be acquired and the Benefit received by the Government: The subject requisition is for the procurement of annual site license renewal of OpenEye products. The following purchase request is needed to continue usage of Open Eye products and to continue data analysis continuity by using the same evaluating software from project to project. This software bundle has been under evaluation free of charge for two years at the NIH Chemical Genomics Center. The NIH Chemical Genomics Center is a component of the NIH Roadmap’s Molecular Libraries Program. The center discovers and develops small molecule probes to study the function of gene products. OpenEye products provide two types of uses at our center: Scientific applications; management and analysis of small molecules, modeling of proteins and small molecule interactions and Software Development; Toolkits for modeling and cheminformatics: the Informatics group at the NCGC has undertaken an inhouse software development effort to build an open source software system that handles the innovative operations of our center. OpenEye’s scientific toolkits are needed in our software development efforts. The site licensing of these products also allows the informatics group to deploy these scientific applications throughout our organization. OpenEye products are among the best in the molecular modeling world and consist of software development toolkits that are available in various technical platforms including support for C++, Java, and Python programming languages. In conclusion, there are no comparable suite of products to OpenEye’s that’s described above. In order to compare OpenEye’s products, one must break down each individual tool and compare. To compare the modeling tools, you have to consider companies like Tripos, Accelrys, Schrodinger. However, those companies do not have comparable products to OpenEye’s beyond modeling tools. Furthermore, the modeling tools are often more complementary than directly comparable. To compare the programming toolkits, the closest comparison is Daylight Chemical Information’s toolkits. However, these again can be complementary at times. In addition, Daylight’s toolkits work well in C programming language envrionment. OpenEye’s are built upon C++. All of these factors, including the excellent site license price, contribute to a unique combination of products from OpenEye. We have been using this program now for three years and it is crucial to the function of this lab. 5. Independent Government Estimate: N/A 6. Specific, detailed explanation of why it is not feasible to obtain full and open competition. Sole Source Justification. The sole-source determination is based upon the fact that OpenEye is currently providing licensing to NHGRI. This software is critical to many ongoing projects currently being processed by the informatic section and any changes in software would cause unwanted and unknown variables by using any other inferior source. There are no other known vendors that can supply the complete software package being requested from Open Eye. 7. Statutory Authority. Federal Acquisition Regulation (FAR) Subpart 13.106-1. (b) Soliciting from a single source. (1) For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, or industrial mobilization). No other requirement and/or type for supply or service will satisfy agency need. 8. Market research: The review of previous purchase orders for the identical requirement. 9.
