Description
RECOVERY PWR ARRA CRMO PMIS 129834 For Information Only - Notice of Intent to Award Sole Source Modification to 8a Contract, CRMO Fire Detection, Craters of the Moon National Monument. RECOVERY TAS::14 1035::TAS RECOVERY CRMO PMIS 129834 The National Park Service intends to negotiate and award a firm fixed price contract modification in the amount of $43,238 to C2 Construction, 805 So. 18th West, Suite 100, Mountain Home, Idaho 83647 for additional construction and renovation at Craters of the Moon National Monument, near Arco, Idaho. This is not a request for competitive proposals and is published for the purpose of providing public notification. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the Agency and the Contracting Activity: Department of Interior, National Park Service, North Cascades National Park. 2.Nature and/or Description of the Action Being Approved: Modification of contract C9280090406 for additional within scope work at Craters of the Moon National Monument and Preserve. 3. A Description of the Supplies or Services Required to Meet the Agency's Needs, Including the Estimated Value: Modification, additional within scope work at Craters of the Moon National Monument and Preserve; added work includes using 4" water lines to all park buildings including housing instead of 2" which the contractor thought they could use until flow rate calculations were determined and engineered drawings were reviewed (flow rates could not be taken until freezing temperatures had ended for safety reasons), trench locations were changed and lengthened along with pipe quantities to mitigate natural resource concerns, new phone lines and trenches were necessary once it was determined that the old phone service to the buildings was unreliable. Net increase $43,238 (original award $218,472) 4.An Identification of the Statutory Authority Permitting Other Than Full and Open Competition: COTI 1443.6-01, as amended, DIAPR 2008-10 and FAR 6.3 5.A Demonstration That the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: This is a design build ARRA project that was properly synopsized and awarded as a competitive 8a contract. As a design build project some details of the project were not available to the contractor during the Request for Proposal process and only became apparent during the design phase of the project and once the snow was off the ground. The contractor (C-2 Construction) was selected under this Best Value RFP due to their technical ranking, satisfactory track record with CRMO, and low bid proposal; NPS personnel also determined post award the contractor would be required to locate trenches in specific locations; monitor temperature in fire riser buildings; and install new phone lines which were not stated in the Request for Proposal. There was no way to reasonably foresee the changes until design was further developed within the Scope of Work with park consultation and the ground free of snow. 6.A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies: The modification was properly synopsized since this action is funded under ARRA. 7.A Determination by the Contracting Officer That the Anticipated Cost to the Government Will Be Fair and Reasonable: Pricing for the additional work has been reviewed by the Program Manager and the Contracting Officer, documentation is on file. 8.A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted: Market Research was conducted for the original contract. This added work is closely related to the original scope of work, it would not be practical to try and obtain a second contractor to do part of the additional work required. 9.Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302-2 (9) (i) - (iii) for some examples): N/A 10. A Listing of the Sources, If Any, That Expressed in Writing, an Interest in the Acquisition: N/A 11. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required: This action was properly offered to and accepted by the SBA as competitive 8a action.
