This announcement constitutes the only solicitation. Proposals are being requested and a written solicitation will not be issued. GAO anticipates award of a fixed price contract for a Base Year in fiscal Year 2010 (date of award) plus two (2) Option periods. This combined synopsis/solicitation is organized into nine parts: (1) General Requirements; (2) Specific Requirements; (3) Licensing Agreement; (4) Cost Proposals; (5) Technical Evaluation and Award; (6) Applicability of FAR Provisions ; (7) Late Clause; (8) Point of Contact; (9) Attachments: A- Pricing Schedule. This combined synopsis/solicitation is organized into nine parts: (1) General Requirements; (2) Specific Requirements; (3) Licensing Agreement; (4) Cost Proposals; (5) Technical Evaluation and Award; (6) Applicability of FAR Provisions ; (7) Late Clause; (8) Point of Contact; (9) Attachments: A- Pricing Schedule. (1) GENERAL REQUIREMENT: The U.S. Government Accountability Office (GAO), the investigative arm of Congress, requires loan-level mortgage data and a detailed house price index. GAO will use this data to respond to requests from Congress to examine various aspects of the nation's housing and mortgage markets. GAO supports the Congress in meeting its constitutional responsibilities and helps improve the performance and accountability of the federal government for the benefit of the American people. Nearly all of its work is mandated in legislation, requested by the chairs or ranking minority members of congressional committees or subcommittees, or requested by individual members. GAO is responsible for conducting research and providing information that helps Congress address both short-term, immediate policy issues, and issues that are newly emerging, longer-term in nature, broad in scope, and have implications across the government. The three core values that underlie GAO's work are accountability, integrity, and reliability. (2) SPECIFIC REQUIREMENTS : GAO has identified in this statement of work requirements that are specifically related to the data. The vendor must be able to meet all the specific requirements outlined in order to be considered for award. (1) Loan-level data on the characteristics and performance of residential mortgages in the United States since at least 2000. The data must provide broad coverage of the mortgage market, including •· prime, subprime, Alt-A, and government-guaranteed and -insured mortgages •· securitized and non-securitized mortgages •· first and second liens The data must contain information on •· loan characteristics, including origination date, term, market segment (prime, subprime, Alt-A, government-guaranteed or -insured), first or second lien, securitized or non-securitized, purpose (purchase or refinance), fixed or variable rate, loan-to-value ratio, contract interest rate, and original and current balance •· historical and current loan performance, including delinquency and foreclosure status. Information on loan performance must be updated at least monthly. •· borrower characteristics, including credit score, debt-to-income ratio, and occupancy/investor status. •· property characteristics, including zip code, appraised value at origination, and property type (single- or multi-unit). The data also must include sufficient information to determine whether a loan has been modified. (2) A repeat-sales house price index for properties in the United States, with historical information going back to at least 2000. The index must •· provide broad coverage of the housing market, including properties with conforming and nonconforming financing and properties in disclosure and non-disclosure states. •· provide statistically valid index values at the national, state, metropolitan area, and zip code levels. •· be updated at least quarterly. (3) Offerors must provide complete definitions of the data elements provided, including numeric or alphabetic codes used in the mortgage data or house price index. Offerors must make staff available for support and technical assistance either in person, by telephone or other electronic means of communication as appropriate to respond to questions from GAO staff regarding the data. Technical support and assistance must be available within normal business hours (9:00 am to 5:00 pm Eastern Standard Time or Daylight Time). (4) Offerors must provide documentation of the steps they use to ensure the quality of the data, including any changes made to the data reported to them. GAO analysts must be able to access the data and output either on individual personal computers or through the GAO network. The data provided by the Offeror must allow GAO staff to produce output in a format that can easily be imported into a spreadsheet (Microsoft Excel) and statistical programs (SAS, SPSS). (5) As part of their proposal, Offerors must provide GAO a random sample of at least 1,000 records from the loan-level mortgage data and information on the completeness of each data field in the overall data set, such as the number of missing values. (3) LICENSING AGREEMENT: The licensing agreement shall contain provisions stating that •· any renewal will occur only if mutually agreed upon by GAO and the Licensor. •· interpretation of the provisions will be governed by the federal laws of the United States and that lawsuits arising out of, or relating to, the agreement shall be commenced in the Federal court of competent jurisdiction. •· the Licensor acknowledges that GAO is not authorized to withhold from Congress information, including records containing confidential information obtained from the Licensor. •· GAO, as a Federal agency, is exempted from all federal, state, and local taxes. •· GAO is allowed to retain for at least 5 years, for workpaper retention purposes, extracts and summaries of data upon which its analysis of mortgage and housing markets was based. •· GAO is allowed to publish reports containing its analysis of mortgage and housing markets based on the data that are subject to the agreement. The licensing agreement may not contain a provision whereby GAO agrees to indemnify the Licensor against any claim arising out of, or relating to, GAO's use of the data. (4) COST PROPOSALS An official authorized to bind the offeror must sign the proposal. Offerors must also complete the required representation and certifications. Failure to furnish the required representation and certification or rejection of the terms and conditions of the solicitation may exclude your offer from consideration. Also, Offerors will be required to complete a Pricing Schedule (See Attachment A) that identifies the costs over a base year plus (2) option year periods. Cost proposal (Pricing Schedule, see Attachment A) is to be prepared and should be part of the total proposal package. The total amount for each year (base and each option period) and a grand total amount for the base and all option periods should be calculated in the schedule. Cost Proposals are to be prepared using the Pricing Schedule and should be submitted with one (1) original and four (4) copies. (5) TECHNICAL EVALUATION AND AWARD: A. Technical Questions: Any questions concerning this requirement must be submitted in writing no later than 12:00 noon (EST) August 9, 2010. An amendment will be issued to address all questions received. However, the source of the questions will not be referenced. Questions should be sent to Contract Specialist- Deja Craddock at craddockd@gao.gov. B. Technical Proposal Requirement: Technical Proposals will address the specific requirements along with the Data Samples mentioned under Section 2-Specific Requirements. Technical Proposals are to be prepared and should be submitted with an original and four (4) copies. To determine whether the Offeror's loan-level mortgage data meet GAO's specifications, the Offeror is to submit along with its cost proposal, a random sample of the loan-level mortgage data and information on the completeness of each data field in the overall data set. GAO will make the award to the responsible Offeror whose offer conforms to the specific requirements, including the license agreement, and represents the lowest cost or price to GAO. GAO will evaluate prices for data licenses with a one-year base period and up to two (2) option years. Acceptance of an offer will not obligate GAO to renew the licenses beyond the one-year base period. The resulting contract from this solicitation shall be awarded in the aggregate. Offers will be evaluated for the purpose of award by adding the total cost or price, inclusive of fee, for all option periods to the total cost or price, inclusive of fee, for the base period. GAO intends to make award on initial offer but reserves the right to conduct discussions, if necessary. (6) APPLICABILITY OF FAR PROVISIONS: The following Federal Acquisition Regulations (FAR) provisions and clauses apply to this solicitation and are incorporated by reference. FAR 52.212-1- Instructions to Offerors (Commercial Items). Offerors must include a completed copy of FAR provision 52.213-3- Offeror Representations and Certifications (Commercial Items) with their offer. FAR 52.212-5- Contract Terms and Conditions Required to Implement Statues or Executive Orders (Commercial Items). FAR 52.212-4- Contract Terms and Conditions (Commercial Items), Conditions, except for subparagraph (d) Disputes. (7) LATE PROPOSAL CLAUSE (A) Any proposals, modifications, or revisions, received at the Government office designated in the solicitation after the exact time specified for receipt of offers is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late proposal would not unduly delay the acquisition; and (1) there is acceptable evidence to establish that it was received at the Government installation designated for receipt of proposals and was under the Government's control prior to the time set for receipt of proposals; or 2) it is the only proposal received. (B) If the proposals, modification or revision was transmitted through electronic commerce method authorized by the solicitation, such transmission shall be deemed "late" unless it was received at the initial point of entry to the Government installation not later than the exact time specified for receipt of proposals. (C) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted. (i) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, electronic records, and other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel. (ii) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume. (iii) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. (A) Proposal Due Date: Proposals are due in this office no later than 2:00 p.m. (EST) August 13, 2010 and must be submitted as a complete package (i.e. samples, technical responses and cost proposals). (B) Delivery Options: Due to the current mail situation and the extra time needed to process incoming deliveries (mail/ documents/ packages), the only acceptable methods in delivering proposals to GAO are Federal Express (FEDEX) delivery service. Other delivery methods are not acceptable for this requirement.
