Description
SF 1449 SOLICITATION/CONTRACT/ORDER FOR COMMERCIAL ITEMS This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation from which bids are being requested, and a written solicitation will not be issued. This announcement is an Invitation for Bid (IFB). The solicitation number is AB133M-10-RB-0020 and incorporates provisions and clauses in effect through Federal Acquisition Circular No. 2005-44 dated 07/08/10. The resulting contract will be a firm-fixed price type contract for #2 diesel fuel. The period of performance commences with contract award and concludes with fuel delivery on August 13, 2010. This procurement is unrestricted. The NAICS code is 454319 which has a size standard of $7 million. Contract Line Item Number (CLIN) 0001 - The contractor must provide a firm fixed price for 1 lump sum to provide all personnel, equipment, and facilities to refuel NOAA Ship Fairweather located in Nome, AK on August 13, 2010 in accordance with the following: 1.0 INTENT - Safely and in accordance with all local and federal regulations the contractor will provide all necessary personnel, equipment, and facilities to provide 35,000 gallons of #2 Diesel fuel to NOAA Ship Fairweather on or about, August 13, 2010 in Nome, AK. 2.0 REFERENCES - N/A 3.0 REQUIREMENTS - In accordance with all applicable local and federal laws and in accordance with standard industry practice. 4.0 PROVIDE COPIES OF PERMITS AND CERTIFICATES Provide the ships Officer of the Deck (OOD), or designated Contracting Officer's Representative (COR) with all applicable permits and certificates. 5.0 PROVIDE WRITTEN EVIDENCE LIABILITY INSURANCE -In accordance with common industry practice to the ship's OOD or COR. 6.0 PROVIDE REFUELING PLAN - Provide refueling plan prior to refueling evolution to the ship's OOD or COR, which includes emergency response procedures in accordance with standard industry practice. 7.0 VERIFY THE ADEQUACY AND COMPLETENESS OF PREPARATIONS TO ENSURE THAT THE SHIP IS IN ALL RESPECTS READY FOR SAFE REFUELING - The contractor must be responsible for determining the type, size and rating of the necessary fueling equipment. However, the fuel must be #2 diesel. 8.0 PROVIDE REPORTS - The contractor must, in the event of an emergency, provide a report to the OOD, or COR Immediately. 9.0 Test/Reports/Inspections - Contractor shall allow inspection of the work by the COR or his/her designated representative. Provide a 24 hour advance notice to the COR to avert production delays. Prepare a quality assurance report documenting the inspection and forward one copy of it to the COR. Provide copies of all required permits and certificates as required in Section 4.0 of this solicitation. 5.0 Provide written evidence of insurance as required in Section 5 of this solicitation. 12.4 Provide a Refueling Plan as required in Section 6.0 of this solicitation. Provide reports as required in Section 8 of this solicitation. Provide emergency reports as required in Sections 8. The following FAR provisions and clauses are applicable to this acquisition: The provision at FAR 52.212-1, Instructions to Offerors-Commercial (JUN 2008), applies to this acquisition. This competition is an Invitation to Bid (IFB). Award will be made to the lowest bidder found responsive and responsible with respect to the requirements of this solicitation. The following addenda apply to this clause: Offerors must include with their bid an originally signed SF-1449 with a completed price schedule that reflects a lump sum fixed price for all costs associated with fueling the vessel in Nome, AK no later than August 15, 2010 (CLIN 0001). All contractors doing business with the Government are now required to be registered with the Central Contractor Registry (CCR) and may register at the following web site: http://www.ccr.gov. This procurement requires offerors to complete the On-Line Representations and Certifications Application (ORCA) at https://orca.bpn.gov/. The provision at 52.212-2, Evaluation-Commercial Items (JAN 1999), applies as follows: (a) The Government will award a contract to the lowest priced, responsive, responsible bidder. Bids will be evaluated in accordance with FAR 13.106. (b) A written notice of award or acceptance of a bid, mailed or otherwise furnished to the successful bidder within the time for acceptance, which unless specified otherwise is 20 days after bids are due, must result in a binding contract without further action by either party. Before the specified expiration time, the Government may accept a bid, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items (MAR 2009), applies to this acquisition.
