- The purpose of Amendment 0002 is to add Progress Payments for the First Article Material, and to extend the solicitation date. FIRST: Progress Payments for the First Article Material are hereby authorized. SECOND: As a result of the authorization of the stipulated Progress Payments, the following solicitation provision and clauses are applicable to this solicitation. PART II - CONTRACT CLAUSES, SECTION I 52.232-16 Progress Payments (JUL 2009) (IAW FAR 32.502-4(a)) (1) Due date. The designated payment office will make progress payments on the 30th day after the designated billing office receives a proper progress payment request. In the event that the Government requires an audit or other review of a specific progress payment request to ensure compliance with the terms and conditions of the contract, the designated payment office is not compelled to make payment by the specificed due date. Progress Payments are considered contract financing and are not subject to the interest penalty provisions of the Prompt Payment Act. 252.232-7004 DoD Progress Payment Rates (OCT 2001) (IAW DFARS 232-502-4-70(b)) PART IV - REPRESENTATIONS AND INSTRUCTIONS, SECTION L, INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS OR RESPONDENTS 52.232-13 Notice of Progress Payments (APR 1984) (IAW FAR 32.502-3 (a)) THIRD: Also, as a result of Provision FIRST, the solicitation date is extended as follows: FROM: 21 JUN 2010, 3:00 P.M. CDT TO: 30 JUL 2010, 3:00 CDT FOURTH: IAW this amendment; offeror's, who previously submitted a proposal for this requirement may revise their proposed pricing for re-submittal to the Government no later than the revised closing date and time in Provision THIRD. If no revised proposal pricing is received from an offeror that previously proposed, then their original submission will be accepted as their firm offer. FIFTH: Except as provided herein, all other terms and conditions of this solicitation remain unchanged and in full force and effect.
