DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, Network Contracting Activity 8, VA Caribbean Healthcare System, San Juan, Puerto Rico. 2.Description of Action: This is a request for other than full and open competition for the procurement of construction services for the installation of two Air Handling Units (AHU) in the Radiology Service at VA Caribbean Healthcare System, San Juan PR. VA intents to negotiate and award a firm-fixed price, sole source, contract with Belkro Corporation, a Service-Disabled Veteran-Owned Small Business (SDVOSB) company. Government estimate is $30,000.00. 3.Description of Supplies or Services: Contractor will provide all labor, materials, tools, equipment, and supervision to install the two Government furnished Air Handling Units in the roof of the Radiology area. Work includes rigging, installation of new piping and fittings, electrical connection, ductwork, insulation and all other necessary fittings to have the units working. Estimated time for completion is thirty (30) calendar days after NTP. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Validity of Use of Statutory Authority: Two waiting areas in Radiology, as well as two exam rooms & offices, are being served by these units (AHUs). Due to the persistent high temps and high humidity levels, employees and patients in this area of Radiology are being affected and immediate remedial action is required. Belkro Corporation is selected to do such work since the company has the required personnel with the expertise necessary to complete the work in the shortest possible time and is already mobilized at the area currently working in several construction contracts. Contractor has a vast experience in working with VA and has completed several critical renovation projects of HVAC at this site. Performance has been excellent and projects have been completed on time. Contractor is very knowledgeable of VA procedures and requirements as demonstrated in previous work. Contractor has been determined to be responsible with the experience and capability to complete the work in the shortest time possible under these circumstances. Contractor is registered in the CCR and a is a SBA Certified Service-Disabled Veteran-Owned Small Business (SDVOSB) company. 6.Actions to Promote Competition: This is a one time action. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $30,000.00. Contractor's proposal will be evaluated against the estimated cost. Negotiations will be held, if required, in order to reach a fair and reasonable price. 8.Market Survey (FAR 10): No market survey was performed due to the urgent and compelling nature of the work required. Refer to paragraph 5. 9.Other Considerations: None 10.Listing of Sources that expressed, in writing, an interest in the acquisition: None. Refer to paragraph 5. 11.Statement of Actions to Overcome Barriers to Competition: None.
