- The Commodity Futures Trading Commission ('CFTC' or 'Commission') intends to award a sole source modification for additional contractor support during Option Year I of contract CFOM-09-CO-0177 with Fox RPM Corporation. Through this contract, CFTC accesses a computer-aided facility management (CAFM) system, FoxFMS, which is hosted by the contractor. The base period of the contract, which expires on September 23, 2010, required the contractor to implement the system, and also includes system access, maintenance and technical support. Furthermore, the base year includes 805 direct labor hours, where the contractor uses the system in furnishing direct support of the Commission's current space expansion project and additional space management activities. The option years of the contract presently include only system access, maintenance and technical support of the system. CFTC's space expansion project is continuing. As such, the Commission has determined that it requires additional ongoing direct support into Option Year I. CFTC intends to modify the contract to incorporate 840 hours of direct labor into Option Year I, to continue the contractor's support of CFTC's space expansion project and to perform additional space management activities within the system. CFTC anticipates that by the conclusion of Option Year I (September 23, 2011), it will not need dedicated support, and that future work within the CAFM system will be performed solely by CFTC personnel. Due to the contractor's ongoing involvement in the Commission's space expansion project, and since the FoxFMS system is proprietary to Fox RPM Corporation, the Commission considers Fox RPM to be uniquely qualified to continue providing the required support services. This notice of intent is not a request for competitive proposals and no solicitation is available. However, the Government will consider responses from all responsible sources received by 3:00 p.m. local (Washington, DC) time on August 4, 2010. Written responses must include sufficient information to establish capability to fulfill the requirement. Any responses received will only be considered for the purpose of determining whether to conduct a competitive procurement in lieu of the sole source modification described in this notice, and such determination shall be made at the sole discretion of CFTC.
