DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, Puget Sound Health Care System (VAPSHCS), Seattle, WA. 2.Description of Action: This justification is for other than open competition for maintenance and repair services to be performed by Advance Sterilizer Products (Johnson & Johnson Health Care System INC). 3.Description of Supplies or Services: The VAPSHCS has a requirement for the vendor to perform preventive and corrective maintenance services on the Sterrad NX Sterilization System. This equipment is critical for the Medical Center's continuous sterilization process. 4.Statutory Authority: (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (x) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: IAW FAR 6.302-1 (a)(2) Advance Sterilizer Products is the only vendor authorized to service this equipment. IAW FAR 6.302-2(a)(2)(b)(2) delay in the award of this requirement could result in serious injury to our Veterans. Services performed by unauthorized vendors and the installation of unauthorized parts could result in costly damage to equipment. 6. Actions to Promote Competition: IAW FAR 5.202(a)(2) the proposed contract action is urgent and compelling. The referenced vendor is the only known source for this service, there is no known secondary source. 7. Determination of Fair and Reasonable Price: The anticipated price to the Government is $18,252.13. IAW FAR 13.106-3(a)(2)(ii). Based on historical cost for previous services performed by the vendor, pricing is determined fair and reasonable. 8.Market Survey (FAR 10): Due to the urgency of this transaction, market research was not conducted.
