Description
Justification for Other Than Full and Open Competition FAR 6.303-2 Content. (a)Each justification shall contain sufficient facts and rationale to justify the use of the specific authority cited. As a minimum, each justification shall include the following information: (1)Identification of the agency and the contracting activity, and specific identification of the document as a "Justification for other than full and open competition." VA North Texas Health Care System, Dallas, TX VISN 17 (2)Nature and/or description of the action being approved. Purchase Request 549-10-4-464-0020 for purchase and installation of a walk-in controlled environment room for the newly activated Fort Worth Clinic, which is projected to be fully operational and servicing eligible veteran patients by August 2010, from Frost Environmental Rooms, Houston, TX. (3)A description of the supplies or services required to meet the agency's needs (including the estimated value). The requirement is to provide an environmental walk-in cooler, with an estimated value of $37,500 that must meet specific dimensions due to space limitations and is required to provide laboratory services at the new Fort Worth Community Outpatient Clinic (CBOC). This walk-in environmental cooler will allow the clinic to store reagents, supplies, and patient samples which must be kept in a controlled refrigerated climate. (4)An identification of the statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is 41 USC 253 c (2) ( or 10 USC 2304 c (2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-2, Unusual and Compelling Urgency (5)A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Frost Environmental Rooms is uniquely qualified to furnish and install an walk-in environmental room which meets the government's specifications based on the following: a. Due to the opening of a newly constructed Ft. Worth CBOC eligible veteran patients are scheduled for various medical service in August 2010. Frost Environmental Rooms can provide a walk-in environmental refrigerated room, which meets the government's specific dimensions required for the Ft Worth CBOC and will not require utility changes. Due to limited space requirements, Frost Environmental Rooms is able to accommodate the requirement without modifying equipment. Frost is also able to provide equipment, installation, and train staff on the cooler prior to the projected opening of the new Ft. Worth CBOC. Use of this vendor will ensure a contiguous, on-time installation for the new facility. (6)A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. The contracting officer has determined that FAR 5.202(a)(2), Exception does apply to this acquisition. "The proposed contract action is made under the conditions described in 6.302-2 (or, for purchases conducted using simplified acquisition procedures, if unusual and compelling urgency precludes competition to the maximum extent practicable) and the Government would be seriously injured if the agency complies with the time periods specified in 5.203 ¦" (7)A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The contracting officer has determined, based on the opening of the Ft Worth CBOC and urgent need, the anticipated cost to the government are fair and reasonable. Commercial item in the marketplace appears to be comparable or higher in terms of price. (8)A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. Federal Supply Schedule (FSS) website was checked; however no vendor appeared to be capable of meeting timeframe or specification requirements. (9) Any other facts supporting the use of other than full and open competition, such as: (i)Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. There are specific dimensions required for the walk-in cooler we purchase for this clinic. The walk-in cooler from Frost Environmental Rooms meets these set dimensions and we will not have to make any utility changes. When FAR 6.302-1 is cited for follow-on acquisitions as described in FAR 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. (ii)When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government. Estimated cost of equipment, installation and training of staff is $37,500. Due to the urgent need for the equipment to effectively store reagents, supplies, and patient samples which must be kept in a controlled refrigerated climate, eligible beneficiary patients can potentially be seriously harmed, if improper storage of samples may alter medical results. (10) A listing of the sources, if any, which expressed, in writing, an interest in the acquisition. Due to the urgent and compelling nature of the acquisition a synopsis was not conducted, pursuant FAR 5.202. (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. Steps will be taken to educate the customer on future requirements, in reference to Acquisition Planning. (12) Contracting officer certification that the justification is accurate and complete to the best of the contracting officer's knowledge and belief. (b) Each justification shall include evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
