- RECOVERY - THIS ACQUISITION WILL BE FUNDED IN WHOLE OR IN PART BY THE AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009 (ARRA) PUBLIC LAW 111-5. This is a Special Notice for Information Purposes Only. The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole source basis, in accordance with the guidance in FAR Subpart 13.501(a)(i) with Carl Zeiss Corporation of Peabody, MA for the purchase of a Helium Ion Microscope (HIM). The HIM (Orion-BU) has been demonstrated to be the only microscope that can achieve a resolution of <5 Angstroms for a scanning microscope on bulk specimens. The use of Helium for imaging also offers some additional capabilities not available with other technologies. For one, the charging of the specimen by the He ions can easily be compensated with an electron flood gun. This allows imaging of insulating samples at the highest resolution allowing characterization of biological samples without coating in metal. Also, the reduced probe size in this microscope will allow advanced lithography capability for photonic crystals, micro-junction squids, and meta-materials. Finally, this microscope will capable of performing Rutherford backscattering spectroscopy (RBS) on nanoscale areas. RBS is a powerful tool for material characterization that has been employed for many years. Until the advent of the HIM, RBS has been limited to beam-line sources and relatively large specimen areas. As a result, the HIM manufactured by Carl Zeiss is the only system that can meet the Government's minimum requirement. Delivery shall be FOB Destination and be completed in accordance with the Contractor's commercial schedule. As defined in the Federal Acquisition Regulation (FAR), FOB destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, delivery and shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and /or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at delivery point specified in the purchase order, and pay all charges to the specified point of delivery. The contractor shall deliver all line items to NIST, 325 Broadway, Boulder, CO 80305-3328. The North American Industrial classification System (NAICS) code for the acquisition is 334516, and the size standard is 500 Employees. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, the government will consider responses received by July 29, 2010. A determination by the government not to compete the proposed acquisition based upon responses to the notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
