Department of Memorandum Veterans Affairs Date: June 28, 2010 From: Donyale Smith, VISN 5 Contracting Officer To: Contract File Subject: Appropriations Law Seminar Justification & Approval JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION: In accordance with Federal Acquisition Regulation (FAR) 6.303, justification and approval for other than full and open competition is hereby approved for the issuance of the contractual action described below using other than full and open competition pursuant to the authority cited herein. 1. CONTRACTING ACTIVITY: Department of Veterans Affairs Veterans Integrated Service Network (VISN) 5 849 International Drive, Suite 275 Linthicum, MD 21090 2. NATURE OF ACTION BEING APPROVED: This justification and approval is for the award of a sole source contract to International Training Consortium, Inc. (Contractor) to conduct appropriations law training at VISN 5. 3. DESCRIPTION OF SERVICES AND SUPPLIES: Contractor shall provide two four-(4) day Appropriations Law Seminars (Fundamental Training) in an undetermined location in the Linthicum, Maryland area on August 16-20, 2010 (Session 1) and October 25-29, 2010 (Session 2). Estimated number of attendees for each training is 30. Objective of the seminar is to increase attendee's knowledge of Federal Appropriations Law as related to their scope of work within the Department of Veterans Affairs. Training must be tailored to the Federal Government and be specific to the Department of Veterans Affairs. Contractor shall provide students/participants with an analytical framework for identifying and resolving appropriations law issues that arise within the Department of Veterans Affairs. The total contract value is $11,950. Contractor shall provide course materials for each student, and students will keep this course material. In addition, four (4) Principles of Appropriation Manuals and any corresponding CDs, etc. will be provided for issuance to the facility Chief, Fiscal Service, and the VISN 5 Chief Financial Officer. Training certificates from the vendor shall be provided to each student upon completion of the seminar. Course Outline: At a minimum, course outline shall include the entire following five (5) core areas listed below: 1. Anti-Deficiency Act 2. Bona Fide Needs Rule 3. Multi-Year Contracting 4. Obligating and Disbursing Funds 5. VA's Appropriations (train participants on the purposes and principles of federal fiscal law as it relates to the VA) 4. STATUTORY AUTHORITY: The requirement was procured under Public Law 109-461, Sec. 8127 (Veterans First Contracting) and in accordance with FAR 6.302-5 (Authorized or Required by Statute) 5. RATIONALE SUPPORTING USE OF AUTHORITY CITED ABOVE: Pursuant to Public Law 109-461, Section 8127 (Veterans First Contracting) and as codified in 38 U.S.C. 8127(c), contracting officers may use other than competitive procedures (including sole-source awards) for contracts to Service-Disabled Veteran-Owned Small Businesses (SDVOSB) and Veteran-Owned Small Businesses (VOSB) where the anticipated price will exceed the Simplified Acquisition Procedures threshold, but not to exceed $5,000,000 (including options). The contractor, International Training Consortium, Inc., is a registered SDVOSB, as verified at http://www.vetbiz.gov. 6. EFFORT TO SOLICIT POTENTIAL SOURCES: VISN 5 did a Sources Sought notice at the Government Point of Entry at Federal Business Opportunities (www.fbo.gov) on (date) to identify and invite potential sources to submit quotes for the Appropriations Law training. The contractor was the only source identified. 7. DETERMINATION OF FAIR AND REASONABLE COST: VISN 5 has reviewed and determined that the total contract value of $11,950 is fair and reasonable. 8. MARKET RESEARCH: Market research was conducted through the use of a Source Sought notice through the Government Point of Entry at Federal Business Opportunities (www.fbo.gov). 9. ADDITIONAL SUPPORT: N/A 10. OTHER INTERESTED SOURCES: N/A 11. FUTURE COMPETITIVE PLAN: This will be a one-time training funded by VISN 5. No future competitions for this type of training are contemplated at this time. 12.
