Description
Clarification #1 to RFI#3 Clarification #1 to Request For Information (RFI) #3 Description / Purpose: 1. A communication from a company that plans to respond to RFI#3 informed us that the company does not fully understand the requirements for a response to this RFI. The company stated it will respond to the "second part" of the RFI but did not demonstrate correct awareness of what comprises the "second part". The company thought the RFI questions were to address either one of the two factors mentioned in I(2)(a) of RFI#3. SMC's response: A respondent to RFI#3 has the option of providing the information requested in II(3) and II(5) (aka Question 1, or "Section A" per the RFI), or to answer II(6) (aka Question 2, or "Section B" per the RFI), or to answer both questions. For each question, a respondent must address the factors in listed in II(4) as directed in II(4) and II(6)(a). The two requirements listed in I(2)(a), must both be addressed as part of an answer to Question 1. The factors listed in II(4) drill down on those requirements and provide you with an outline for your response. 2. A couple companies have asked whether they should or could include a revised response to RFI#2 as part of their response to RFI#3 SMC's response: No. Please provide two documents: (1) a revised RFI#2 (if you responded to that RFI and plan to revise your response) by July 26 and (2) a separate response to RFI#3. Companies that responded to RFI#2 have already been notified by e-mail of the option to revise their responses and the suspense for that revision (COB July 26). The revision to RFI#2 must adhere to the format and requirements of RFI#2; respondents are encouraged to use the templates they already prepared. RFI#3 requirements mandate use of a substantially different template (more complex outline, much more information requested and larger page limits). The documents may not be merged. 3. One company also asked whether subcontractors would have to certify their business size according to the size limit ($27M) imposed by the final NAICS code chosen for LISC - 541330 Engineering Services (Military and Aerospace Equipment and Military Weapons). SMC's response: In all cases, to qualify as a small business, subcontractors must meet the size standard (see 13 CFR 121) for the NAICS code of the subcontract. The prime contractor is required to assign a NAICS code to each subcontract, based on the nature of the work being subcontracted, using the 2007 North American Industrial Classification System coding manual and the footnotes in 13 CFR 121. Subcontracted work which is similar to the basic contract should use the same assigned NAICS (in this case 541330). While the prime is not bound to use the same NAICS code for all effort that is subcontracted which is similar in nature to the contract NAICS code assigned for the prime contract, deviations must clearly fit the NAICS description chosen. In other words, a company planning to bid as a prime can assign different NAICS codes to subcontracts but must be prepared to defend its use as appropriate in light of the work performed on the subcontract; a NAICS code cannot be picked for the sole reason to obtain a larger size limit than that imposed by NAICS code 541330.
