Description
Clarification For All Offerors Submitting Full Proposals to BAA 10-10. The purpose of this amendment to BAA 10-10 is to revise the Anticipated Schedule of Events listed on page 17 of BAA10-10 and to provide clarifications to all offerors submitting full proposals. The updated Anticipated Schedule of Events is as follows: Invitations to submit full proposals sent out - 14 July 2010. FULL PROPOSAL WEBSITE REGISTRATION DEADLINE - 29 July 2010. FULL PROPOSAL DUE DATE - 4 August 2010 Notification of selection for award negotiations - 30 August 2010. Instructions to all offerors submitting full proposals. As a clarification for all offerors submitting Full Proposals, please note the following items: A. The Government will, as part of this effort, request that offerors use a pre-determined image data set to perform preliminary data processing for demonstration purposes. Each offeror will be asked that its team members sign a non-competitive non-disclosure agreement (NDA), which will allow the Government to release these images. The implications on vendors and software developers are as follows: 1. For vendors, where ‘vendor' is defined as an Original Equipment Manufacturer (OEM) for AIT hardware and coordinating software that is currently either on the Transportation Security Administration (TSA)'s Qualified Products List (QPL) or in process to be tested for Qualification: a vendor will receive image data for the system it produces and will not be allowed any image data from other vendors. 2. For potential vendors, where ‘potential vendor' is defined as those OEMs who produce AIT system hardware and coordinating software that have not yet entered the Qualification approval process: upon signing this agreement, the potential vendor agrees that it will not submit an AIT system for approval to the QPL for five years after contract award. 3. For algorithm developers, where ‘algorithm developer' is defined as those offerors who do not produce AIT hardware, but will produce algorithms that are intended to be integrated onto those systems on the TSA QPL: the offeror may receive any image data produced by S&T for evaluation of this effort. However, if the algorithm developer forms a teaming agreement to team with any vendor (as defined above), then that algorithm developer waives its right to receive data from any vendor and may receive image data only from the system of the vendor it has teamed with. The offeror has the right to waive the offer for the image data, however the offeror must also present sufficient rationale as part of its proposal regarding how its algorithms will process relevant AIT images. B. The offeror will observe the Assertion of Data Rights detailed requirements of the BAA and the statement in paragraph 1.8.2 that the "Government also reserves the right to ownership of the ATR Algorithms (including source and executable code) after final delivery," with respect to the amount of intellectual property it puts forward in support of this effort. The offeror will state what components of its effort that it intends to retain as intellectual property as part of the proposal. C. The offeror must be able to handle Sensitive Security Information to perform this effort, and will include its capability to do so and other relevant clearance information for both the offeror's personnel and facility as part of this effort. D. The offeror will include as part of its proposal information on funding sought from other sources in support of this effort. Additionally, the offeror will explain how that funding will supplement the effort being proposed to this BAA. PLEASE BE SURE TO ADHERE TO ALL INSTRUCTIONS CONTAINED IN BAA10-10.
