- This synopsis is for a commercial item in accordance with Federal Acquisition Regulation (FAR) Subpart 13.5-Test Program for Certain Commercial Items. This procurement is for a thermomechanical simulator with tension, compression and torsional capability to augment NSWCCD's materials simulation capabilities. In support of this effort, NSWCCD intends to negotiate a non-competitive procurement using Simplified Acquisition Procedures and award a firm-fixed price purchase order to Dynamic Systems Inc. The statutory authority permitting other than full and open competition is 10 U.S.C 2304(c)(1) pursuant to FAR 6.302-1- Only a Limited Number of Responsible Sources and No Other Supplies or Services Will Satisfy Agency Requirements. Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. All responsible sources submitting offers will be considered. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Interested parties may forward their capabilities statements to the Government POC on or before 28 July 2010, referencing RFQ N00167-10-T-0111.
