- Q19: Paragraph B.5 Wage Determinations of the solicitation states: "All non-professional positions are subject to the McNamara-O'Hara Service Contract Act (SCA). Department of Labor (DOL) wage determinations are locality-specific and can be located at www.wdol.gov. The applicable DOL wage determination for the base period is #05-2543 (rev 11) dated 04/23/2010 for the Aviation Logistics Center in Elizabeth City, NC. The Government will not provide price adjustments for wage-related increases [emphasis added]. The Contractor warrants by submission of its offer that all wage-related costs for the entire contract period are included." The Fair Labor Standard Act (FLSA), as it applies to the referenced Service Contract Act, provides for adjustments of wages in out years of contracts. The emphasized language above would seem to contradict the requirements of the FLSA. Further, Solicitation No HSCG38-10-R-410014 was amended to remove the emphasized language. Will the Government be issuing a similar amendment to Solicitation No HSCG38-10-R-410013 removing the emphasized language? A19: Yes. An updated solicitation is anticipated to be posted today. Q20: The amendment to Solicitation No HSCG38-10-R-410014 also extended the due date for proposals to 09JUL. Will the Government consider also extending the due date for Solicitation No HSCG38-10-R-410013 to 09JUL? A20: Yes. An updated solicitation is anticipated to be posted today.
