Jones County, Texas, One-Year Lease Extension Overview Signed Copy A one-year lease extension from February 1, 2009 through January 31, 2010, was awarded to Mueller Family Partnership, 100 Largent Street, Ballinger, Texas,76821, in the amount of $75,341.10 (representing $6,278.43 per month and $14.03 per square foot) for 5,370 usable square feet. GSA approval was granted for a one-year lease extension with the incumbent landlord without full and open competition for continued occupancy at the above-mention ed location. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED The United States Department of Agriculture (USDA), Farm Service Agency (FSA), Jones County, Anson, Texas, office currently leases 5,370 usable square feet (usf) of office space at 2303 Commercial Avenue, Anson, Texas. The current lease expired 1/31/2009. Approval is requested to negotiate a 1-year lease with the incumbent landlord without full and open competition for continued occupancy at this leased location. The approval of this request for a 1-year extension will allow time for the Jones County, TX, office to pursue a long-term requirement. 2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED The Jones County, TX, USDA/FSA office still has a continuing need for 5,370 usf of office and related space, as the current lease expired on 1/31/2009. USDA/FSA is requesting a 1-year lease extension that commences on 2/1/2009. The estimated annual cost/total contract value for the lease award is $75,341.10 FS / $14.03 p/usf. The delineated area is bound by the following: North By: 14th Street, South By: County Road 376, East By: Avenue C/County Road 389, West By: County Road 475/Avenue L/Avenue P. 3. IDENTIFICATION OF STATUTORY AUTHORITY 41 U.S.C. 253(c) (1): Only one responsible source and no other supplies or services will satisfy agency requirements 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. GSAM 570.402-4 - No Potential acceptable locations; allows for negotiation with the incumbent lessor if you do not identify any potential acceptable locations through the advertisement or the market survey. The results of the preliminary market survey conducted in the field, along with internet searches on www.loopnet.com and www.costar.com did not reveal any suitable office locations that meet the USDA/FSA immediate or future office space requirements. The locations identified in the market survey are outside of the delineated area. The current lessor for 2303 Commercial Avenue, Anson, Texas, 79501, can continue to provide USDA/FSA office space that meets all of the agency current space requirements until a new lease is negotiated using full and open competition. If the commencement date of the new lease is before the expiration of the 1-year lease extension, FSA will execute the cancellation clause that will be included in the 1-year lease extension. There is not any other location available in the county that can meet current space requirements as the current lease is expired. The current lessor has proven to be a responsible property owner in maintaining and operating the premise. 5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICAL. Not applicable 6. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE. In accordance with Federal Acquisition Regulation (FAR) 6.303-2(a) (7), the Contracting Officer determines by certifying this document that the anticipated cost to the Government of $ 75,341.10FS / $14.03 p/usf for the entire requirement is within the prevailing market rents and is considered fair and reasonable. The results of the preliminary market surveys from the field, along with surveys performed on loopnet.com and costar.com did not identify any potential office space that would meet the USDA/FSA immediate or future office space requirements. The market rental rate ranges from $12.00-$15.00 p/rsf or $13.00-$17.00 p/usf for comparable office space. The range represents full service lease rates. The rental rate does not include any tenant improvement allowances. It is estimated to cost approximately $12.00 p/sf to build out the office, ADP room, perform handicapped accessibility upgrades, flooring, carpet, paint and division of space. 7. DESCRIPTION OF MARKET SURVEY CONDUCTED. The following chart is an exhibit of similar class comparable office buildings that are located within Jones County, Anson, Texas, and the surrounding area.
