*********************************************SOURCES SOUGHT******************************************************************* This sources sought announcement is for market research purposes only. The Government does intend to award a contract for services; however, price, delivery and other market information are needed for planning purposes, and to help identify market resources. The Government is NOT obligated to do business with, or enter into a contract with any person, firm, or other entity that receives or responds to this announcement. No reimbursement will be made for any costs associated with providing information in response to this announcement. Interested parties - please submit a Capabilities Statement describing your ability and experience to provide the required services. BACKGROUND The Bureau of Indian Affairs (BIA) Personnel Security Office is tasked with developing and implementing uniform and consistent policies and procedures to ensure the effective, efficient, and timely completion of investigations and adjudication relating to determinations of suitability and eligibility for logical and physical access to BIA/BIE systems and facilities for employees and contractors. The BIA, as the primary Federal liaison with Tribes, is also tasked with providing the same services to Tribes and/or Tribal users who require access to Federal IT systems, or routine, regular access to Federal facilities. In addition, the Indian Child Protection and Family Violence Prevention Act, as amended, requires reinvestigations every five years for all employees having regular contact or control over Indian children. PROGRAM OBJECTIVE To contract with a vendor which will administer the Tribal Personnel Security Program, coordinate with Tribes and tribal organizations who fingerprint and background checks from the FBI Criminal History Record Information (CHRI), and conduct training for Tribal Personnel Security Program participants (participants are Tribal members and/or members of tribal organizations. THE FBI CRIMINAL HISTORY RECORD INFORMATION PROGRAM The Compact Council Office, Federal Bureau of Investigation, in accordance with its "Final Rule" entitled "Outsourcing of Noncriminal Justice Administrative Functions (28 CFR Part 906), "the outsourcing of noncriminal justice administrative functions is permitted when approved by the relevant Compact Officer."The Compact Council Office authorizes businesses specializing in background investigations and fingerprint checks (called "channelers") to receive access to FBI data resources to perform the checks. REQUIRED EXPERTISE A qualified firm (Contract Prime) will have the following expertise:* demonstrated knowledge and experience working with Native American Tribes and tribal organizations,*demonstrated knowledge of the Federal requirements per the Indian Child Protection and Family Violence Prevention Act,*demonstrated knowledge, skill, and ability to administer an investigation program - to conduct fingerprint and background checks,*and most importantly, access to the FBI CHRI either directly, or through a subcontract with an FBI-approved channeler (Subcontractor). Channeler (Subcontractor) functions include: 1.fingerprint submissions to the FBI for individuals who are employed, or are being considered for employment, in a position that involves regular contact with, or control over, Indian children under the age of 18; prospective foster parents, or relative caregivers; prospective, existing, newly-hired employees and volunteers who are involved with the provision of child care services to children under the age of 18; and adult household members where child care or foster care services are being provided in a home;2.and, the concomitant delivery of national fingerprint-based criminal history record check results to the Contract Prime on behalf of the BIA Personnel Security office. ADDITIONAL REQUIREMENTS *Indian Preference: The contractor shall follow Section 12 of the Indian Reorganization Act of 1934 ?472 (1976).**Background Requirements: All contractor staff MUST pass BIA security background requirements. The contractor shall assign one staff member to be responsible for administering the personnel background program. STAFFING Contractor shall provide a senior-level project manager to address issues related to contract performance. The project manager will coordinate with the delegated government official regarding contract performance.Contractor will be responsible for providing replacement contract staff in the event of employee absence. Contractor shall hire as many employees as necessary to meet requirement needs. REQUEST FOR CAPABILITIES STATEMENT The statement, at a minimum, MUST include:"Company Name"Point of contact with phone number and email address"Size of Business according to the North American Industry Classification System (NAICS) code 561210 - Correctional Facility on a Contract or Fee Basis"Other suggested NAICS codes for this program, and your size classification based on those codes (also include DUNS Number, Cage Code, Federal Tax ID)"Description of your company's core expertise "Your experience as either Prime or Subcontractor on the same or similar procurement"Your experience working with Tribes and tribal organizations"Your knowledge of Indian Child Protection and Family Violence Prevention Act (Public Law (Pub.L.) 101-630); the Crime Control Act of 1990 (Pub.L. 101-647)"Your knowledge and experience with the CHRI"A description of the outsourcing agreement(s) you are currently involved in with any agency"Whether or not you (as either Prime or Sub) have been cleared by the FBI to perform the required services for any government agency (if so list them)"An estimate of the cost or price associated with delivering this type of service"Please provide information about any potential problems, or caveats you foresee with regard to this procurement, and/or offer strategies to improve this effort.
