Description: RECOVERY-PER FAR 5.7 THIS NOTICE IS PROVIDED FOR INFORMATION PURPOSES ONLY; THEREFORE FAR 5.203 DOES NOT APPLY. THIS OPPORTUNITY WAS AVAILABLE ONL Y TO THE 8a CONTRACTOR UNDER THE CURRENT CONTRACT NUMBER: FA8501-09-C-0057, PORTER SCIENTIFIC, INC. (DBA: PORTER ENVIRONMENTAL) Demolish tank 96 and build a new 500,000 gallon fire suppression water tank (Project UHHZ 060328A). The 78th Contracting Squadron, Robins AFB, GA has issued this modification of an 8(a) Sole Source Firm-Fixed Price contract to Porter Scientific (DBA: PORTER ENVIRONMENTAL), 719 OLD MAIN RD, Pembroke NC, 28372-8753, Cage Code: 1SLR1, DUNS: 030458991. This acquisition is subject to the North American Industry Classification System (NAICS) code 237110. This project consists of, but is not limited to, furnishing all necessary engineering, labor, tools, supervision, materials, licenses, permits, insurance, transportation, and equipment to replace tank # 96 (a 500,000 gallon fire suppression tank). The project modification required an engineering plan to build the new tanks in the same location as the existing tank so that temporary tanks are required during construction which is a change from the original award when the new tank was engineered to be built next to the existing tank 96. The temporary tanks must provide for the flow of water to the 4 existing 3,500 gallon per minute pumps is not hindered. The tank will be built on a concrete foundation. The tank will have anti-corrosion coatings for long life and durability. Magnitude of this project is between $1,000,000 and $5,000,000.00. This range does not necessarily reflect the proximity of the actual estimated cost. The Government anticipates construction to begin in June 2010. This contract action was accomplished using other than competitive procedures because A statute exists that expressly authorizes or requires that the acquisition be made from a specific source or through another agency (FAR 6.302-5); specifically, FAR 6.302-5(b)(4) Sole source awards under the 8(a) Program -- 15 U.S.C. 637 (see Subpart 19.8 ). Per FAR 6.302-5 a J&A is not required for this award. [The title for this project at http://www.recovery.gov originally read: Mnt/Coat Non-Portable Water Tank, Fr Protec Wtr Stor, #96. The government has chosen to replace these tanks rather than metalizing them based on a cost-benefit analysis.] This work was previously offered to Porter Scientific Inc. by the government at Robins AFB, GA, but funding was unavailable for the project award prior to the Stimulus funds being made available by the congress. By statute the 8(a) program is a sole source program under $3,500,000.00; hence, the government is still offering this work to Porter Scientific under the 8(a) program as a sole source firm fixed price acquisition in accordance with FAR 6.302-5(b)(4).
