Description
Contractor Forms for completion; Contract Clauses; Business Associate Agreement; Workplace Violence memorandum; Courtesy and Respect in the Workplace Policy Notification; and HHS Standards of Conduct This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Programs for Certain Commercial Items (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 253(g) and 253a and 253b), FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)), and FAR Subpart 37.4, Nonpersonal Health Care Services (10 U.S.C. 2304 and 41 U.S.C. 253). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Aberdeen Area Indian Health Service (IHS) intends to award a fixed-price commercial item requirements type contract in response to Request for Quotation (RFQ) RFQ-10-160. The solicitation is issued as a small business set-aside. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-38. The associated North American Industry Classification System code is 621399 and the small business size standard is $7.0 million. PRICE SCHEDULE: 2,080 hours @ $___________________ per hour = $________________________. The quoted "unit price" must be an all-inclusive cost. All "inclusive unit price" is defined to include travel, lodging, per diem, fringe benefits, federal, state and local taxes (contact the local Tribal TERO Office to see if taxes are applicable), plus all other costs pertinent to the performance of this purchase order. STATEMENT OF WORK: The Outpatient Clinic at the Wanblee Health Center is staffed by one (1) full-time family nurse practitioner, whose mission is to provide full-scope, quality health care services to patients of the Oglala Sioux Tribe on the Pine Ridge Reservation. The primary purpose of this contract is for the provision of patient care services to be provided at the Wanblee Health Center by a currently licensed mid-level patient care provider. Patients will be seen primarily in the Outpatient Department. The Contractor shall provide consultative, diagnostic, minor surgical care and treatment for eligible patients of all ages. Physician's Assistant services shall be provided in the Wanblee Health Center Facility. The services will include consultative, diagnostic, routine and minor surgical care. In performance of this procurement the Contractor shall specifically carry out the tasks listed below: 1. Provide examination, diagnosis, prognosis, treatment plan, follow-up and consultation for all patients present for care. All surgeries and/or services which cannot be provided at the Wanblee Health Center Facility require prior approval from the Contract Health Services Office. The Clinical Director will assist the Contractor in the approval process by submitting required documents to the Contract Health Office. The Contractor shall make arrangements for specialized patient care that is required but not available at the Wanblee Health Center facility. Patient referral shall be in accordance with Indian Health Services guidelines. 2. The Contractor shall agree to be available as needed up to 40 hours per week to provide clinical care onsite at the Wanblee Health Center Facility. Patient care services shall be provided according to the following schedule: 8:00 AM to 4:30 PM, Monday through Friday. The Outpatient Department will be the primary location of patient services. 3. The Contractor is subject to the supervision and direction of the Clinical Director or designee. 4. The Contractor will attend to the needs of walk-ins; conduct medical record reviews during down time; and coordinate the transfer of patient care to the next provider as needed. The Contractor will confer with an IHS physician on patient care issues at the end of each tour of duty for the purpose of coordinating and promoting continuity of care. 5. The Contractor shall refer patients to appropriate contracted facilities, providing full clinical information for care and diagnostic procedures that cannot be adequately provided at IHS facilities, utilizing appropriate referral protocol. Procedures for transfer patients presenting with emergencies and requiring transfer to a higher level of care shall follow EMTLA guidelines. 6. The Contractor shall generate and maintain proper medical record information on beneficiaries to whom treatment is provided in accordance with Indian Health Service regulations. The Contractor shall prepare all medical record documentation to meet or exceed the established standards of the facility to include, but not limited to, timeliness, legibility, content, accuracy and signature. 7. At all times, the Contractor shall respect and maintain the basic rights of patients. This is to include, but not limited to personal dignity, privacy and confidentiality. This contract shall begin at the time the contract is awarded and will end at an undetermined date. The Service Unit shall provide office space including a desk, chair and office supplies. The Contractor will be authorized to use all areas of the medical treatment facility available to civil service and commissioned corps personnel in similar positions. The same restrictions apply to the Contractor as any other Indian Health Service personnel to use these areas for official business activities only. The Contractor will be authorized to use all administrative and professional support available to Indian Health Service personnel. This will include but not be limited to copy machines, telefax machines and telephone service. The same restrictions to use these items for official Indian Health Service business apply. The Contractor shall be provided with an orientation to the Indian Health Service. The initial orientation and continuing orientation shall be provided by Service Unit personnel. The Service Unit shall provide all medical and nonmedical equipment and supplies used by the Wanblee Health Center for the care and management of patients. The Service Unit shall provide all required blank government forms applicable to the Indian Health Service. An appropriate orientation to the necessity of such forms will be provided by Service Unit personnel. The Service Unit shall provide an ongoing method of monitoring and evaluation of the quality and appropriateness of patient care and identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. The Service Unit will not provide transcription services. Legible handwritten documentation of medical records is acceptable in place of recorded dictation. The Indian Health Service does not anticipate a need for Contractor furnished equipment, however any instrument or piece of equipment specifically preferred or requested by Contractor may be allowed after approval by the Clinical Director. The Contractor shall comply with the following quality of care protocol: 1. It shall be understood that eligible patients under treatment will be rendered services that provide the best medical care within the Contractor's professional training and experience. All services rendered shall be in accordance with current standard medical practices to assure quality of care. 2. The Contractor shall be familiar and adhere to the policy and procedures of the Bylaws of Medical/Dental Staff of the Indian Health Center, Wanblee, South Dakota. The credentials of the Contractor shall comply with the Medical Staff By-laws of the Service Unit for all services provided in Public Health Service clinics. The Contractor shall agree to abide by the JCAHO standards. 3. The quality of work performed by the Contractor will be subject to review by chart audits and site visits by the Project Officer or designee. 4. The quality of work performed by the Contractor will also be subject to review by the Medical Staff of this facility. 5. A list of the current formulary for medical use will be available to the Contractor and he/she shall prescribe medications found on it as much as possible although exceptions are allowed with proper justification. 6. The mid-level patient care provider will provide documentation of current board certification, licensure, diplomas/specialty certificates, DEA Licensure, recent health examination, three (3) current professional references, liability insurance/liability claims/adverse actions, continuing education, and will also support the ongoing continuous quality improvement at the Service Unit. The mid-level patient care provider application and clinical privileges will be reviewed in accordance with the Wanblee Health Center credentialing process. 7. The Contractor shall have no work or health restrictions that would interfere with the performance of patient care services and duties outlined in the Statement of Work. 8. The Contractor shall familiarize himself/herself with the particular needs of the Wanblee Indian Health Service patient population. 9. The Contractor shall be sensitive to the cultural aspects of providing health care to Native Americans. 10. The Contractor shall speak, understand, read and write English fluently. The Contractor shall communicate with sufficient clarity to be understood by the patients and staff of the Wanblee Service Unit. 11. The Contractor shall maintain standards of personal hygiene and grooming compatible with the expectation of the Wanblee IHS. 12. Individuals providing services under this contract, which involve regular contact with, or control over, Indian children, are subject to a character investigation in accordance with the "Indian Child Protection and Family Violence Prevention Act" P.L. 101-630. The Indian Health Service Personnel Office will conduct these investigations following award of a contract unless in the judgment of the Contracting Officer, in consultation with the Personnel Officer, investigation may be waived based on prior investigations on file. Until the character investigation has been completed and the Contracting Officer notified, such individual shall not have unsupervised contact with Indian children. The Contracting Officer has the authority to temporarily waive the character investigation of a Contractor. The "Agreement to a Temporary Waiver of Character Investigation" authorizes an agency to hire a Contractor prior to the completion of a background check provided that at all times the Contractor is within the sight and under the supervision of a Government employee who has successfully completed the National Agency Check with written Inquiries (NACI). INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit a signed and approved invoice to request payment on at least a monthly basis. (a) The Contractor shall submit and original invoice to: Accounts Payable, Aberdeen Area Indian Health Service, Division of Financial Management, 115 4th Avenue SE, Room 309 Federal Building, Aberdeen, South Dakota 57401; (b) The Contractor shall include the following information on each invoice in accordance with the Prompt Payment Act (5 CFR Part 1315.9(b)): 1. Contractor's name; 2. Invoice number and date; 3. Entire award number or other authorization number for delivery of goods or services; 4. Description (including dates of service), price, and quantity of goods and services rendered; 5. Shipping and payment terms; 6. DUNS number and Taxpayer Identifying Number (TIN); and 7. Contact name (where practicable), title and telephone number. Payment shall be made by the Aberdeen Area Financial Management Branch, Room 309 Federal Building, Aberdeen, SD 57401. Service payment to Contractor will be provided by Medicare and Medicaid Program of the Wanblee Health Center. The Government reserves the right to accept or reject services if the level of work is unsatisfactory. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offerors Commercial Items (August 2009); 52.212-2 Evaluation - Commercial Items (Jan 1999); 52.212-3 Offeror Representations and Certifications Commercial Items (August 2009) are attached in full text with instructions for completion. Upon request, the Contracting Officer will provide full text copies of the FAR and HHSAR provisions and clauses.
