- Description
- The Centers for Medicare & Medicaid Services (CMS) intends to award a sole source follow-on contract, per FAR 6.302-3(b)(3)(i) (41 U.S.C. 253(c)(3)(c)), to Blue Cross Blue Shield of Chicago, Illinois, to perform the arbitration services in regard to disputed home health claims. CMS has entered into individual agreements with the State Medicaid agencies of Connecticut, Massachusetts, and New York to operate a demonstration program to determine the Medicare payment of certain home health services provided to certain individuals. If any one of the states or its agents is dissatisfied with CMS' determination of Medicare coverage for these claims, the parties have agreed to utilize arbitration services provided through the American Arbitration Association to resolve the dispute. This project is being conducted under CMS' statutory authority to conduct Medicare demonstration projects, 42 U.S.C. 1395 b-1. Basic Tasks 1. Upon receipt of the TPL Demonstration Project Appeal Request form, the CMS Project Officer will approve the request, assign a task order number and forward confirmation via e-mail to the contractor. 2. When one of the states or its agents files a demand for arbitration for home health care cases that are under dispute, the contractor shall select and assign the cases to an arbitrator from a roster of arbitrators to which CMS and tat state have mutually agreed. In the event that an arbitrator is unable to serve or is disqualified, the contractor shall assign the case to another arbitrator. 3. Within 30 days of the filing of a demand for arbitration, the contractor shall hold a telephone conference with the par5ties and/or their representative and the arbitrator to discuss the future conduct of the case, including clarification of the issues and claims, a schedule for the arbitration hearing and other preliminary matters. 4. Within 10 days after the pre-hearing conference, the contractor will schedule the hearing and notify the parties of the scheduled date and location of the hearing. Hearing will be held and the contractor hearings facilities in Boston, Massachusetts, Hartford, Connecticut, or New York City, New York. 5. The contractor will perform general case management of each arbitration to assure that each arbitration is completed in accordance with the Demonstration Rules. 6. The contractor will invoice CMS for the arbitrators' fees and expenses (as well as contractor's fees" and will issue payments to the arbitrators.
