Dec Page, Addendum, Agreement, Clauses, Business Associate Agreement, Violence in the Workplace Memos, Courtesy and Respect in the Workplace, and HHS Residual Standards of Conduct This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Programs for Certain Commercial Items (10 U.S.C. 2304(g) and 2305 and 41 U.S.C. 253(g) and 253a and 253b), FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)), and FAR Subpart 37.4, Nonpersonal Health Care Services (10 U.S.C. 2304 and 41 U.S.C. 253). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Aberdeen Area Indian Health Service (IHS) intends to award a fixed-price commercial item purchase order in response to Request for Quotation (RFQ) RFQ-10-158. The solicitation is issued as a small business set-aside. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-38. The associated North American Industry Classification System code is 621320 and the small business size standard is $7.0 million. PRICE SCHEDULE: BASE YEAR: 744 hours @ $__________________ per hour = $________________________. The quoted 'unit price' must be an all-inclusive cost. All 'inclusive unit price' is defined to include travel, lodging, per diem, fringe benefits, federal, state and local taxes (contact the local Tribal TERO Office to see if taxes are applicable), plus all other costs pertinent to the performance of this purchase order. BACKGROUND: The statutory authority for IHS to enter into non-personal services contracts for the provision of services in facilities owned, operated or constructed under the jurisdiction of the IHS is P.L. 103-332, Department of the Interior and Related Agencies Appropriation Act, Title II, September 30, 1994, 108 Stat. 2530, as implemented by 25 U.S.C. 1638c. The provision of FAR Part 37, HHSAR Part 337 and Chapter 5-5.7 of the Indian Health Manual prescribe the procedures for personal services contract awards. PURPOSE OF CONTRACT: The primary purpose of this non-personal service contract position is to provide direct patient Optometry care. The mission of the Wanblee Health Center, Pine Ridge Service Unit, Aberdeen Area Indian Health Service is to provide the best possible health care services to the Native American people on the Oglala Lakota (Sioux) Indian Reservation in South Dakota. To meet the mission, the Wanblee Health Center requires contracting support to assist the service unit in the recruitment of an Optometrist, hereafter referred to as the Contractor. The care and prevention activities shall be as comprehensive as our service unit permits. The Contractor is responsible for direct patient care and adhering to the policies and procedures of the Wanblee Health Center. The contract resulting from this solicitation shall: Be a non-personal health care service contract under which the Contractor is under the administrative supervision of the Wanblee Health Center. Allow the government to evaluate the quality of professional and administrative services provided. GOVERNMENT FURNISHED PROPERTY, FACILITIES AND SERVICES: The Clinic shall provide a patient examination area and all medical and non-medical equipment and supplies used in the Indian Health Service facility for the care and maintenance of patients. The Clinic shall provide an on-going method of monitoring and evaluating the quality and appropriateness of patient care, and of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. Methodology involves peer review on patient charting, peer evaluations, support personnel evaluations, documented complaints, and incident reports. The Optometrist shall be provided with an orientation to the Indian Health Service and the Indian Community being served. The Wanblee Health Center personnel shall provide the initial orientation and continuing orientation. CONTRACTOR FURNISHED PROPERTY, FACILITIES AND SERVICES: The Government does not anticipate any required Contractor furnished property, facilities, or services for the duration of this contract. STATEMENT OF WORK: The primary functions of the Optometrist shall include the following: The contractor will provide up to three eight (8) hours per day week of services. Contractor will perform services from 8:00 am to 4:30 pm, with ½ hour for lunch. The contract Optometrist, on occasion may need to work for short periods of time beyond 4:30 pm, at times when such extra time is necessary to finish a patient visit. The Optometrist is allowed two (2) fifteen minute breaks per day. The contractor will work under the supervision of the CEO. The Contractor will secure a health and development history from the patient or parent; records findings and makes critical evaluations. Provides surveillance over medical practices applied to stabilize chronically ill persons; adjusts treatment within established standing orders, recognizing when to refer the patient to a physician or other health team members. Works collaboratively with physicians in management of selected complex medical problems. When clinically engaged with a medically complex patient the Contractor will present the case to the physician clinic consultant for the day for proper treatment and disposition. Participates with other health professionals and agencies involved in providing health care and services required to include immunization and disease control, environmental health and health education. Evaluates the medical aspects of treatment plans, periodically recognizing the need for reassessment by a physician or other health professional. Maintains records and reports on patients, personal activities and other required information for use in program operation, quality control and other purposes. All medical record information generated in the performance of this contract will remain the property and subject to the exclusive control of the Indian Health Service. The Contractor shall comply with all IHS facility infection control and safety procedures, practices and standards. The Contractor shall meet all applicable Joint Commission on Accreditation of Healthcare Organization and Centers for Medicare/Medicaid Services standards during the performance of this contract, and must be in compliance with the Service Unit's Medical Staff Bylaws. This individual must be eligible for enrollment in the service unit's Medicare part B program, so as to enable the hospital to bill for the Contractor's services. The Contractor shall respect and maintain the basic rights of patients, to include but not be limited to personal dignity. KNOWLEDGE REQUIRED: Skill and knowledge of established concepts, principles, and practices related to health care assignments requiring training equivalent to an educational program leading to a Bachelors Degree and additional training or experience in assessing the conditions of patients, in providing medical care and in advising on health care needs, all with full consideration of mental, emotional, and physical factors. Extensive knowledge of disease entities. Ability to collect, organize, record and communicate, in a meaningful way, data relevant to primary health assessments. Knowledge of pharmaceuticals in order to recognize the desired effects, side effects and complications of their use. Knowledge of human behavior during stressful situations in order to exercise emotional control, tact, patience and reliability in providing emergency/ urgent patient care. Ability to provide individual and family counseling, guidance, and health instruction to help patients to understand how to prevent disease and maintain good physical and mental health. Qualifications: The Contractor must hold an active, current, and unrestricted state Optometry license from any of the 50 United States or the Commonwealth of Puerto Rico. The Contractor cannot be under any exclusions or sanctions from the Medicare/ Medicaid programs. The Contractor must be a graduate of a certified Optometry program, and must have nationally-recognized certification in this specialty. The Contractor must fulfill all the requirements for appointment to the Wanblee Health Center and for the granting of privileges, in accordance with IHS policies and with the Service Unit Medical Staff Bylaws. The Contractor must have three written letters of recommendation less than one year old. The Contractor must have laboratory titers results showing immunization to Hepatitis B. The Contractor must have had a PPD performed and read in the past year. Documentation is required. If positive, treatment must be confirmed with a negative chest radiograph. Quality Assurance/Supervisory Control is under the administrative supervision of the CEO of the Wanblee Health Center. The CEO will monitor the contractors work and provide feedback to the contractor. Guidelines include standing orders, protocols and agency procedures. Guidelines are not completely applicable. Uses judgment in interpreting guidelines. COMPLEXITY: The work consists of providing a range of health services from assessment through intervention, counseling, teaching and treating illnesses. Health care services are being delivered to the patients of the Pine Ridge Native American reservation where a very rate of Diabetes Mellitus (DM) is prevalent along with the usual DM co-morbidities. Determines health services needed in the community, and assists the community in planning, developing, and evaluating their local health care delivery system. Reporting Requirements: Contractor is required to report to work on time and will notify the supervisor if he/she will be late for any reason. Contractor must wear the appropriate IHS badge at all time while working in the IHS facility. Scope and Effect: The purpose of the work is to deliver health care to individuals and families. The work affects the physical well being of persons in the community. Federal Tort Claims Liability: Pursuant to Section 224 of the Public Health Service Act, 42 U.S.C. 233, the Federal Tort Claims Act Coverage for medical related claims is extended to individuals providing services performed while working within the scope of the personal services contract. The coverage does not apply to non-personal services contractor. IRS Reporting Requirements: Contractor is required to pay all Federal, State, and local taxes. The Indian Health Service will not withhold taxes of any kind. Personal Contacts: The Contractor will have contact with patients, families, and with various staff members in all departments in the facility. Purpose of Contact: To provide health care, and to collaborate with the CEO on review of work. Physical Demands: Standing and bending is required in treating patients. Work Environment: Exposure to contagious diseases is possible in the OPC, field clinic, and ER setting. Also, possible exposure to bodily fluids may occur in the course of caring for trauma patients. CHARACTER INVESTIGATION: Individuals providing services on personal or non-personal services contract (the duties and responsibilities of which involve regular contract with, or control over Indian children) are subject to a character investigation. IHS Personnel Office will conduct these investigations following awards of personal or non-personal service contract unless in the judgment of the Contracting Officer, investigation may be waived based on prior investigations on file. Until the character investigation has been completed and the Contracting Officer notified, such individuals shall not have unsupervised contact with Indian children. PERIOD OF PERFORMANCE: The performance of this contract shall be from May 31, 2010 through December 31 or 744 hours whichever comes first. INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit a signed and approved invoice to request payment on at least a monthly basis. (a) The Contractor shall submit and original invoice to: Accounts Payable, Aberdeen Area Indian Health Service, Division of Financial Management, 115 4th Avenue SE, Room 309 Federal Building, Aberdeen, South Dakota 57401; (b) The Contractor shall include the following information on each invoice in accordance with the Prompt Payment Act (5 CFR Part 1315.9(b)): 1. Contractor's name; 2. Invoice number and date; 3. Entire award number or other authorization number for delivery of goods or services; 4. Description (including dates of service), price, and quantity of goods and services rendered; 5. Shipping and payment terms; 6. DUNS number and Taxpayer Identifying Number (TIN); and 7. Contact name (where practicable), title and telephone number. Payment shall be made by the Aberdeen Area Financial Management Branch, Room 309 Federal Building, Aberdeen, SD 57401. The Government reserves the right to accept or reject services if the level of work is unsatisfactory. PROVISIONS AND CLAUSES: The following provisions and clauses apply to this acquisition. The FAR provision 52.212-1 Instructions to Offerors Commercial Items (August 2009); 52.212-2 Evaluation - Commercial Items (Jan 1999); 52.212-3 Offeror Representations and Certifications Commercial Items (August 2009) are attached in full text with instructions for completion. Upon request, the Contracting Officer will provide full text copies of the FAR and HHSAR provisions and clauses.
