Notice Type:Special Notice Title: Notice of Intent to Award Other than Full and Open Competition for Aviation and Maintenance Contract Extension for one year with six month option for services Contract:DE-AC52-06NA25694 The purpose of this special notice is to post a Justification for Other Than Full and Open Competition. The National Nuclear Security Administration (NNSA) Service Center in Albuquerque, New Mexico, plans to contract by means other than full and open competition per the Competition in Contracting Act (CICA) on behalf of the Office of Secure Transportation (OST), Program Office for Aviation Operations (POAO) for the contract that operates and maintains six (6) aircraft for OST/POAO in Albuquerque, New Mexico. OST/POAO is responsible for the safe and secure transport of nuclear weapons, special nuclear materials, and weapons components between production facilities and Department of Defense facilities via surface and air modes of transportation by Federal agents. This extension will allow OST/POAO time to sell the DC-9 airplanes and eliminate operations and move toward the implementation of the Boeing 737 aircraft program plan as it transitions from the DC-9 aircraft to the Boeing 737 aircraft with a commensurate incremental de-scope of the USA Jet Airlines contract as the Boeing 737 assumes the complete operational mission. As one Boeing 737 aircraft becomes mission capable one DC-9 aircraft will be disposed of and the current services contract will be de-scoped. This extension to the current contract is necessary to ensure uninterrupted aviation support to the OST Federal Agent workforce and is necessary to ensure the safe and secure transport of nuclear weapons, special nuclear materials, and weapons components between production facilities and Department of Defense facilities. Normally a new competition would be held at the end of the present contract to ensure maintenance and operation of the DC-9 aircraft until the aircraft are sold. However, due to the nature of OST?s mission and the unique requirements of the Federal Aviation Administration, if this contract is not extended OST/POAO will not be able to meet its mission requirements without substantial duplication of costs. Four issues have significant negative impact: (1)The DC-9 airplanes cannot be flown immediately by a successor contractor as it takes a minimum of 120 days for the FAA to include the aircraft on the new company?s operating certificate.(2)The 120 day time constraint is relevant only if the selected contractor currently holds an operating certificate for the DC-9 aircraft, otherwise the FAA certification period could exceed 180 days.(3)Only a few airlines currently hold an FAA DC-9 aircraft operating certificate therefore the probability of exceeding the 120 day minimum certification period is very likely.(4)OST/POAO will be compelled to duplicate costs by paying for aviation services under a lease or per flight payment arrangement to meet its aviation mission requirements at the same time as it?s paying a contractor to maintain the DC-9 aircraft while awaiting FAA certification. This extension from December 1, 2011, to November 30, 2012, with the six month option will allow OST/POAO sufficient time to award the new maintenance contract; acquire Boeing 737 aircraft; assume the OST/POAO mission with the Boeing 737 aircraft; and dispose of the legacy DC-9 airplanes without duplicative cost for continuing operations. This contract extension is being pursued to ensure the same level of required aviation services are maintained while implementing the sunrise/sunset program activities. An uninterrupted and seamless transition is required to ensure that OST/POAO aviation missions do not fail. The Contracting Officer shall award the modification to the current contract to meet the government requirement for continued aviation support for one (1) year with one six-month option extension to the current contract DE-AC52-06NA25694 with USA Jet Airlines, Inc. of Belleville, Michigan. The statutory authority for other than full and open competition is 10 U.S.C. 2304 (c) (1), Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirement. The applicable NAICS code is 481211 Nonscheduled Chartered Passenger Air Transportation and the size standard is 1500 employees. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES OR A SOLICITATION FOR OFFERS. However, any firm that believes it can meet the requirements, as outlined above may give written notification prior to the response due date. Responses are required to be submitted before May 28, 2010, 3:00 p.m. Mountain Time. Responses shall be submitted via e-mail to csisneros@doeal.gov and supporting evidence must be furnished in sufficient detail to demonstrate the ability to perform the requirements listed. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government.
