- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Combined Synopsis/Solicitation: 626CROWELL0001 In accordance with FAR 6.302-1 it has been determined that EMC is the only company that is able to satisfy the agencys requirement for the Maintenance of EMC CX3-40F rack components and software as follows: Serial Number APM00062801213 Serial Number APM00062800612 (to include FOX10200373 and JAB1031N2Y2) Serial Number APM00091301644 Serial Number FOX10170250 The government intends to procure commercially available hardware and software maintenance via a firm fixed price contract. The maintenance will be used to support the Redstone Test Center (RTC) (Provisional). EMC Corporation (EMC) manufactures the equipment and software. Research, Development, Test, and Evaluation Dollars will be utilized for this procurement. EMC, 176 South Street, Hopkinton, Massachusetts, 01748-2209 is the only manufacturer of the equipment (hardware) and software. These are proprietary to the contractor as they are the sole source developer and distributor of both hardware and software. No other manufacturer can provide the service as EMC has not licensed any vendors. This combined synopsis/solicitation document and incorporated provisions and clauses are those on effect through Federal Acquisition Circular 05-40. This requirement is not a set-aside as this is a sole source acquisition. The associated NAICS Code is 541519. The Small Business Size Standard is: $25,000,000.00. The inclusive dates of this contract will be from on or about 17 May 2010 through 30 September 2010. Requisition Number: W81MTJRTC00741 The provision at FAR 52.212-1, Instructions to Offerors-Commercial applies to this acquisition. According to FAR 52.212-2 the Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors such as technical capability, delivery, and past performance will be considered. The following factor shall be used to evaluate offers: Only Nortel Certified Technicians can perform maintenance on the equipment. According to FAR any offers should also include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items. (CCR, ORCA) The clause at 52.212-4, Contract Terms and Conditions- Commercial Items, applies to this acquisition. The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, (APR 2009) (Deviation) applies to this acquisition. The contractor must be able to use WAWF (Wide Area Workflow) for payment in accordance with DFARS 252.232.7003, Electronic Submission of Payment Request and Receiving Reports (March 2008).
