- Department of Veterans Affairs JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following Justification, I hereby approve, as the Contracting Officer, the solicitation of the proposed contract described using other than full and open competition pursuant to the authority of 38 U.S.C. 8127 (c). JUSTIFICATION 1.Agency & Contracting Activity: U.S. Department of Veterans Affairs, Coatesville, PA, VA Medical Center, Acquisition Material Management Office, VISN 4 2.Nature of Action Being Approved: Contracting without providing for full and open competition. 3.Description of Supplies or Services: Boiler Tube Replacement, Project # 542-09-124. The Office of Engineering Services has requested that Sea Knights Associates, LLC be awarded a sole source contract for this requirement. Contract period of performance will be 210 days from the Notice to Proceed. The total estimated cost is $494,178.39. 4.Statutory Authority: 38 U.S.C. 8127(c) contracting officers may use procedures other than competitive (including sole source awards) for SDVOSB and VOSB for awards exceeding the Simplified Acquisition Procedures threshold but not to exceed $5,000,000. 5.Rationale Supporting Use of Citation in No. 4: Citation 38 U.S.C. 8127(b) in direct accordance with FAR 6.302-5. 6.Synopsis or Other Efforts for Identification of Sources: The procurement was synopsized in accordance with FAR Part 5 as required by the Veterans First Contracting Program (VAAR Part 819.7007). This requirement will be awarded as a Contract action pursuant to FAR Subpart 6.302-5. 7.Determination of Fair and Reasonable Anticipated Cost: The proposed costs for the effort will be analyzed in detail by the Contracting Officer to ensure that they are realistic, fair, and reasonable. 8.Market Survey: A formal market survey was not conducted for this effort in accordance with FAR 10.001(a)(2). Inquiries received will be given due consideration. 9.List of Other Interested Sources: The proposed contractor is the only qualified source for these services. 10.Future Plans to Permit Competition: The Government will continue to evaluate, on an ongoing basis, any interest shown by sources in competing for this requirement on subsequent acquisitions. Subsequent acquisitions will be competed if the Government determines the availability of technically qualified sources that can meet the Governments requirement for compatibility with the current system (to include warranty requirements).
