GENERAL SERVICE ADMINISTRATION REGION 3 JUSTIFICATION FOR OTHER THAN FULL & OPEN COMPETITION Office of Personnel Management Cranberry Woods Building One Cranberry, PA 16066 Project ID: 9PA2102 1. Proposed Action: To acquire a new ten year lease, five years firm for the Office of Personnel Management, Office of the Inspector General for 4,096 ANSI/BOMA office area square feet (ABOA). The current lease, GS-03B-01323, expires October 8, 2011. 2. Description of Requirement: The Office of Personnel Management (OPM), Office of the Inspector General (OIG) currently occupies 2,435 ABOA square feet of Class A office space on the first floor of Building One at the Cranberry Woods complex in Cranberry Township, Butler County, PA. The current lease, LPA01323, expires on October 8, 2011. OPM and the Federal Bureau of Investigation are under the same lease at this location. The current lease has termination rights, in whole, with 365 days written notification to the Lessor. OPM's current annual rent is $70,880.18. OPM OIG is authorized in its 2009 appropriation and proposed 2010 budget to increase its overall staffing level. The Cranberry Woods location houses both audit and investigative staff. An OPM office in Jacksonville, FL is the only other office to house an audit field staff besides the location in Cranberry Township. In 2009, it was determined by OPM OIG that the increase in staff levels would result in the need for additional space. <Redacted> On April 6, 2009 OPM sent an email to GSA requesting additional square footage at their current location due to its proposed increase to its staff level at the Cranberry Township location. Presently, OPM OIG has decided <Redacted> According to the agency the space needs breakdown as follows: 1 Private Office at 140 - 166 square feet 9 cubicles totaling approximately 1,060 square feet of office area (including circulation) 1 Small Conference Room Area for printers and fax machines <Redacted> Due to the impending lease expiration date, GSA and the agency determined that the best way to proceed is to enter into a new lease at the increased square footage with the current Lessor. The agency has stressed that they need the space as quickly as possible because the new hires will be starting work in the coming months and OPM does not have adequate room to house them in their current work space. The proposed action is for a new replacing lease with the current Lessor at the Cranberry Woods Complex. The proposed leasing action would be for 4,096 ABOA square feet. <Redacted> The total cost of the ten-year lease contract is estimated to be $<Redacted>* ($<Redacted> ABOA X 4,096 ABOA X 5 years including Tenant Improvements Allowance of $<Redacted> /ABOA amortized at <Redacted>% PLUS $<Redacted> /ABOA X 4,096 ABOA X 5 years). It should be noted that this is their full TI Allowance. The agency has stated that the current first floor space will not need any alterations. Consequently, the TIA will be reduced accordingly. A potential move to a new location will require the agency to utilize their full Tenant Improvement Allowance. * Assuming no operating cost escalations. 3. Identification of Statutory Authority : FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. In accordance with GSAM 570.402-1, a cost-benefit analysis indicates that award to an offeror other than the present lessor will result in substantial relocation costs or duplication of costs to the Government, and the Government cannot expect to recover such costs through competition. 4. Demonstration that the Acquisition Requires Use of Authority Cited: In accordance with 41 USC 253 (c) (1), when the supplies or services required by the agency are available from only one responsible source, or from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for to meet the agency's needs. Due to the impending lease expiration date, GSA and the agency determined that the best way to proceed is to enter into a new lease at the increased square footage with the current Lessor. Proceeding with a full and open acquisition would require approximately <Redacted>months to complete. The agency has stated that this time frame will not be acceptable. The attached cost benefit analysis reveals expanding in the current location is in the best interest of the Government. If OPM OIG were to relocate, the agency would need to expend<Redacted>.. Additionally, the agency would incur the costs of installing data and telecommunication systems in the new space as well as move costs. However, remaining in their current space and expanding to the second floor would allow the agency to reduce their TI build-out expenditure as well as the cost of data and telecommunication installation. Finally, the agency would also realize cost savings from the relocation and move costs by remaining in their current location. Based on mission requirements and a cost benefit analysis, the Contracting Officer recommends that GSA pursue a 10-year new replacing lease, five-year firm term with termination rights after the fifth full year of occupancy, for 4,096 ABOA at the Cranberry Woods complex in Cranberry Township, Pennsylvania. 5. Efforts to Ensure Solicitation from Maximum Sources Practical: A Co-Star report and phone market survey was completed for available properties within the delineated area. Based on thorough market research, discussions with the agency, and the results of the Cost/Benefit Analysis, GSA decided that the best housing strategy at this time would be the proposed leasing action with the current Lessor. 6. Determination as to Fair and Reasonable Cost : OPM OIG is currently paying a rental rate of $29.11/ABOA, fully serviced, for 2,435 ABOA square feet of Class A office space in Building One of Cranberry Woods. Analyzing market rental rates for office space (<Redacted>), the quoted rate for Class A space in or around Cranberry Township, PA is in the range of $<Redacted>/ABOA - $<Redacted>.00/ABOA. The <Redacted>data for the area outside the CBD of Pittsburgh is in the range of $<Redacted>.00 - $<Redacted>(please see attached<Redacted>rates for Pittsburgh provided by Portfolio) with an average rental rate of $<Redacted>(please note, <Redacted> rental rates are stated on a rentable square foot basis). Consequently, the Contracting Officer hereby certifies that the rental rates quoted are considered fair and reasonable. As outlined in the Cost Benefit Analysis, remaining in the current location will eliminate the relocation and duplication costs as well as the need to expend their full TIA, further supporting the reasonableness of the $<Redacted>ABOA rate. 7. Description of Market Survey: See Market Survey Report 8. Other Factors Supporting Justification: As outlined in the attached Cost Benefit Analysis, it is in the best interest of the Government to stay in the current business park. The analysis reveals that a cost savings of $ <Redacted> to $ <Redacted> would be realized by negotiating a new replacing lease with the current Lessor. Additionally, OPM OIG has stated it is satisfied with its space and the responsiveness of the current lessor. Consequently, it has requested to remain in its current location. 9. Statement of Actions to Overcome Barriers to Competition: GSA discussed with OPM OIG the possibility of procuring a new lease through full and open competition. The agency was not receptive to the option because of the immediate need for space. The time frame for a full and open procurement would far exceed the period in which the new staff would be hired. At the conclusion of the lease term, if there is a continuing need, GSA anticipates that the requirement will be competitively procured.
