Description

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITIONFAR 6.302-1, 41 U.S.C. 253 (c) (1) - ONLY ONE RESPONSIBLE SOURCE AND NO OTHER SUPPLIES OR SERVICES WILL SATISFY AGENCY REQUIREMENTS. CONTRACTOR: ZENITH SYSTEMS LLC 1. Agency and Contracting Activity Identification: VISN 10 Contracting Activity located at 10000 Brecksville Road, Brecksville, Ohio, as requested by Louis Stokes Cleveland VA Medical Center, will enter into a contract that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Contractor shall provide all necessary labor, management, supervision, technical skills, quality control, materials, tools, transportation, equipment, demolition of existing items, and performance of work necessary for the Projecct: "Learning Exchange Security Upgrades" at the Learning Exchange, located at 1551 East 105th Street, Cleveland OH, 44106. Work includes but is not limited to the following: Replace existing wrought iron gate, including replacing hinges with four new heavy duty hinges and a new heavy duty 4" square latch post. Furnish and install all materials included on the statement of work and provide material and labor for all connections, testing, adjustments and programming to make a complete working security system. All work shall be performed in strict accordance with the terms, conditions, and specifications, contained or referred to in request for proposal. 3. Description of Requirement: VA is requesting sole source procurement with Zenith Systems LLC to upgrade existing security system at the Learning Exchange to integrate with the new system being installed at the Cleveland VA Medical Center under a separate contract with the Army Corp of Engineers. The estimated cost is $27,600. 4. Statutory Authority Permitting Other Than Full and Open Competition: The service being procured under the authority of 41 U.S.C. 253 (c) (1), FAR Part 6.302-1 (a) (2). 5. The Nature of the Acquisition Requires Use of the Authority Cited: This contract is being procured on a sole source basis due to Zenith Systems LLC having unique knowledge of the LENEL systems and Dell equipment. The LENEL system is a proprietary system with limited certified dealers. Zenith Systems LLC is a certified LENEL and Dell vendor for this area. A contract with the Army Corp of Engineers is currently in progress with Zenith to upgrade the security of the Cleveland VAMC from the current security system to a LENEL sytem. The Learning Exchange security system requires an upgrade as well. Zenith comes highly recommended by the Army Corp of Engineers. A sole source to Zenith would eliminate potential programming conflicts, ensure the project has local LENEL certified installer supplying the product and programming, and will provide a local contractor that is LENEL certified to maintain the warranty on the equipment Accordingly, full and open competition is precluded and Zenith Systems LLC will be utilized to ensure compatibility. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. This procurement was not competed/synopsized due to Zenith having propriety rights on the LENEL System being utilized for this project. This justification will be posted on fedbizopps. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based on the using service estimate. 8. Results of Market Survey: Market research information was obtained through historical data. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. 10. Any Other Interested Sources: There are no other sources that expressed in writing an interest in the acquisition. See Item 6. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: Not Applicable - see item 5 12. Contracting Officers Certification The Contracting Officer has determined that the justification above is accurate and complete to the best of the CO's knowledge and belief.
