Description
This is a firm fixed-price type of contract for the repair of a roof on a building at U.S. Consulate General, Frankfurt, Germany. The roof was damaged on February 28, 2010 by the storm ‘Cynthia' which raged over Germany with gusts over 160 km/h. The bituminous roofing material of the building was peeled off and back over an area of approximately 250 sqm. The roof insulation was exposed to wind and weather; sheet metal gutter inlets, roof vents and the lightening protection were damaged and/or destroyed, and the insulation was soaked. In an emergency repair aimed at preventing further damage to the roof as well as protecting the public, the roofing material had to be cut back to where it was not yet damaged and removed. The wet insulation material was also removed. The vapor barrier had to be repaired where the bathroom vents were ripped out. Patches were installed to prevent rainwater from flowing into the holes. However, the emergency repair was decidedly a short-term solution: the storm uncovered that the existing thermal insulation and thus also the roof membrane is not mechanically glued or fixed to the roof slab. The next storm could take the rest of the roof off. Over one-third of the roof surface still does not drain into the gutters; it simply drains over the edge. Where the roof vents were ripped out, there are still holes. Draining rainwater just doesn't flow into the holes. Last of all, this area no longer has any thermal insulation. Under these circumstances, and in keeping with FAR 603.1 (d), post obtained three bids from three responsible, specialist roofing companies in an effort to speed up the actual roof repair. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c) (2); the regulatory authority is FAR 6.302-2.
