Description
NOTICE OF INTENT TO AWARD SOLE SOURCE PROCUREMENT: Under the authority of FAR 8.405-6, it is the Government's intent to award a sole source service contract to EMASSIST, INC. for the support of liability issues related to the Formerly Used Defense Sites Program within the Potential Responsible Parties (PRP) Process. THIS IS NOT A FORMAL SOLICITATION. This synopsis is not considered a Request for Quotation or Proposal. No solicitation document is available, and telephone requests for a copy of the solicitation will not be honored. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. All responses received within 15 days will be considered. If no affirmative written response is received, the service contract will be awarded without further notice. The Sacramento District Corps of Engineers (SPK) through the Office of Counsel represents the interests of Department of Defense (DoD) on Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) liability issues related to the Formerly Used Defense Sites Program within the Potential Responsible Parties (PRP) process. Currently EMAssist is SPKS contractor who is performing research, investigations, preparing negotiation materials, and related environmental site litigation services at various sites located within the boundaries of the South Pacific Division. Currently EMAssist is providing support services at the following PRP sites and the actions in progress are: PRP negotiations at Titan 1-A, Evaluation of PRP status at AiReasearch/Motorola 52nd Street Superfund Site (AZ), PRP liability analysis report for Walker AFB (NM), Evaluation of PRP status at former Ontario Army Air Field (CA), Document review and updating of the Site Ownership and Operational Histories Reports at Benicia Arsenal (CA), NIRF (CA), and Rialto (CA). The percentage of work completed at each of these sites range from 90 50% with variables and unknowns yet to be determined. A determination by the Government not to compete this proposed service contract is based upon the fact that it would take an inordinate amount of time and an extensive cost to bring in a new contractor at this stage of the process at each of the above listed sites if the Government were not to utilize EMAssist, Inc. for this requirement. Detailed capabilities of interested vendors must be submitted to the following email addresses no later than 2:00 PM (MST) 04 May 2010, madeline.e.livermore@usace.army.mil.
