- Justification for Other than Full and Open CompetitionDue to Sole Source Requirement April 19, 2010 Solicitation Number: VA-244-10-RP-0210 Erie VAMC 135 East 38th Street Erie, PA 16504 Items to be procured: The requirement is to provide one of the following: Liebert 208 Volt, 60HZ, 3 Phase DS Precision Cooling System: Model DS035WUC0EI543A "Nominal 035 kW (10 ton) Water/Glycol Cooled Downflow System with Cleanable paradenser heat exchanger with a net sensible cooling capacity of 98,100 BTUH at 72F, 50% RH Must purchase brand name as described and exact model in order to be compatible with current system in place. This is essential to the government's requirements, thereby precluding consideration of a product manufactured by another company. The purchase of this unit would preclude Erie VAMC from modifying the existing utility that is already in place, which would cause the Erie VAMC to incur additional costs. Purchasing this unit is compatible with the backup Liebert cooling system already in place and software that has been installed that automatically transfers units when one fails. Current unit is failing - if the unit fails when the warm weather arrives, the Erie VAMC could be as risk for losing all data on IT servers. The statutory authority permitting other than full and open competition is 41 U.S.C. 253 (c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Market research indicates that Liebert 208 Volt, 60HZ, 3 Phase DS Precision Cooling System: Model DS035WUC0EI543A is only available from a sole source. It is requested that this contract be awarded to the following vendor (a large business): Emerson Network Power - Liebert 22 McCormick Road McKees Rocks, PA 15136 Notice of Intent to Sole Source was posted to https://www.fbo.gov/ on 04/19/2010 with the expectation that the solicitation will be issued is no later than 04/21/2010 with intent to award no later than 04/30/2010.
