Description

DEPARTMENT OF VETERANS AFFAIRSVA BLACK HILLS HEALTH CARE SYSTEM JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FOR PROJECT 568-10-214, CALL CENTER IN ACCORDANCE WITH 41 U.S.C. 253(c )(1) and FAR 6.302-5 (b)(6) 1. Contracting Organization: VA Black Hills Health Care System, Hot Springs, SD. 2.Nature of Action or Description of the Action being Approved: This will be a sole source, fixed price procurement for the construction project number 568-10-214, Call Center with contractor Gibson-Horsley Inc, Rapid City, SD who is a Services Disabled Veteran Owned Small Business. This work will be performed at the VA Black Hills Health Care System, Hot Springs, SD with a contract completion time of 60 calendar days. 3.Description of the supplies or services requ8ired to meet the agency's needs (including the estimated value: Project 568-10-214, Call Center will remodel current Patient Library into the Call Center for this medical center. Work includes general construction, alterations, mechanical and electrical work, and necessary removal of existing structures and construction and certain other items. Demolition consists of, but is not limited to removal and disposal of the following,: restroom partitions, casework, wall and floor tile, plumbing, urinal, receptacles, receptacle boxes/covers, conduit/wiring, old phone jacks/wiring, data wiring, and asbestos tile. New construction consists of, but is not limited to: Floor prep, installation of carpet and base, installation of sheet vinyl, wall repair doors, install and/or relocation of receptacles, data/voice cable and tip jack install/testing, electrical conduit and wiring install/modifications, and painting. The construction estimate for this project is $60,000.00. 4.Identification of the Statutory Authority Permitting Other Than Full and Open Competition: The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c )(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-5 entitled, Authorized or Required by Statute, Para. (b)(6) Sole source award under the Veterans Benefits Act of 203 (15 U.S.C. 6570) 5.A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited: Gibson-Horsley is a newly formed Service Disabled Veteran Owned Small Business. In checking past performance for general construction work, there is little if no VA past general construction past performance, however; personnel has performed several dozen general construction work for private parties, schools and cities.One past performance reference has been provided reflecting excellent past performance. Gibson-Horsley consists of personnel from another firm who has performed services at this facility and past performance with the personnel has been satisfactory. Gibson-Horsley also is qualified to perform the NAICS code of 562910 Remediation Services so if during the course of this construction project, asbestos is discovered Gibson-Horsley will also be able to perform these services. 6.A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies: A sole source pre-solicitation announcement will be posted.. 7.A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable: The Government has determined a government estimate which will be used to evaluate the contractor's cost proposal. If negotiations are required, they will be conducted so award can be made at a fair and reasonable price. 8.A description of the market research conducted and the results or a statement of the reason market research was not conducted: Market Research has been conducted utilizing VetBiz.gov, CCR and discussions with Service Disabled Veteran Owned Small businesses. 9.Any other facts supporting the use of other than full and open competition: None 10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition: None at this time. 11.A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: No subsequent acquisitions are expected. 12.Contracting Officer's Certification: Based upon the justification provided herein, I hereby certify that the facts and representations under my cognizance, which are included in this justification and which form a basis for this justification are complete and accurate to the best of my knowledge. ______________________________ Contracting Officer Date
