Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20 2.Description of Action: This is a request for other than full and open competition for the procurement of a distributed antenna system (DAS) to be provided and installed by CSI Government Solutions Inc. 3.Description of Supplies or Services: VISN 20 requires a Contractor to provide shop drawings, equipment, and installation service for a DAS in Building 100 floors B2 through floor 4. The work will be located at the Portland VA Medical Center (PVAMC) in Portland, Oregon. The DAS shall be capable of coexisting with and accommodating multiple service providers, radio systems, paging systems and wifi transmission. The PVAMC recently issued an RFP under solicitation VA-260-09-RA-0532 for base bid with 6 alternate bid items. The PVAMC awarded alternate 6 to CSI Government Solutions Inc an SDVOSB concern. We have since come up with the additional funding to complete the rest of the project and we want to issue a sole source contract to CSI Government Solutions Inc. Through negotiations they have agreed to give us a price for the difference between the base bid amount and alternate 6 bid amount. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement (X) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5.Validity of Use of Statutory Authority: Authority found under VA Acquisition Circular 2008-01, 819.7007 Sole Source awards to service-disabled veteran-owned small business concerns. (a) A contracting officer may award contracts to SDVOSB concerns on a sole source basis provided: (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) The requirement is synopsized in accordance with FAR part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with respect to performance; and (4) Award can be made at a fair and reasonable price. (b) The contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting "Award is estimated at $600,000.00 which is under $5,000,000.00 "This action has been posted in accordance with FAR part 5 "The SDVOSB contractor has been determined to be responsible "The price is fair and reasonable based on pricing received from previous solicitations "The contracting officer has determined that it is in the best interest of the Government to award a sole source contract to CSI Government Solutions Inc. A contract award to CSI for the remaining installation of the DAS system in building 100 will insure that the DAS system gives continuity of service and it will lower maintenance cost. 6.Actions to Promote Competition: Future actions to install DAS systems will be offered as SDVOSB set-asides. 7.Determination of Fair and Reasonable Price: Price compares with pricing received under solicitation VA-260-09-RA-0532 for Project 648-09-124 Install Distributed Antenna Building 100 Phase I, it is therefore considered the price that we have received is both fair and reasonable. 8.Market Survey (FAR 10): Solicitation VA-260-09-RA-0532 was recently issued, response received established that there are more than two SDVOSB that can provide DAS systems. 9.Other Considerations: N/A 10.Listing of Sources that expressed, in writing, an interest in the acquisition: N/A, a sources sought will not be conducted because solicitation VA-260-09-RA-0532 was recently issued from which four offers were received. 11.Statement of Actions to Overcome Barriers to Competition: The PVAMC wants to award contracts to install DAS systems to one contractor per building to maintain continuity of services for that given building. To accomplish this, the PVAMC will endeavor to acquire funds for whole building projects at one given time. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bonafide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
