Description
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the agency and the contracting activity: a. Agency: Dept of Veteran's Affairs Employee Education Services (EES) POC: Cindy Showers, Program Contracts Manager #1 Jefferson Barracks, Bldg 2 St Louis, MO 63125 b. Contracting Activity: Dept Of Veteran's Affairs Employee Education System (EES) POC: Derrick Harris, Contracting Officer #1 Jefferson Barracks, Bldg 2 St Louis, MO 63125 St Louis, MO 63125 (2) Nature and/or description of the action being approved. The Office of Employee Education Systems (EES) requests authority for a sole source purchase order for support services to the contracting office for 12 months, with an option to extend for 12 months. (3) A description of the supplies or services required to meet the agency's needs (including the estimated value). During FY09, the office of the contracting lost two experienced contract specialists. Three months later, our only procurement clerk retired. This left the staff with only three contract specialists, and the work of six specialists, where the staff was already in a deficit. In addition, the workload complexity and number increased, without relief from the existing workload. With both EES and acquisitions in organizational transition, funding for staff has been in limbo. With a daunting end of year surge inevitable and no guarantee of additional staff, we are requesting the assistance of contractor support to meet our mission. The period of performance is 12 months, with an option to extend for an additional 12 months. The estimated value of the award is $ (4) An identification of the statutory authority permitting other than full and open competition. In accordance with FAR 10 U.S.C. 2304(c)(2) or 41 U.S.C. 253(c)(2), Urgent and Compelling Need. At this time, Judy Fischer, independent contractor, meets this need. (5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. Judy Fischer is a prior employee of EES Acquisitions. With over 25 years in the field and 10 years with EES Acquisitions, Ms. Fischer is the only source that is local and cost efficient. She retired only three months ago and would experience no learning curve. She knows EES systems, finance systems, VA and Federal procurement regulations. Her position is only valid until we can fill the 70% deficiency rate within the organization. Currently, the reorganization of Acquisitions into a centralized career field has put filling these positions "on hold". With an end of year surge on our horizon, we need to be able to staff capable, experienced people to assist us in completing our mission. Ms. Fischer fills that need for us. (6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. In accordance with FAR 5.2.2(a)(2), this is a simplified acquisition and delay would result in significant mission impact. Currently, we are "borrowing' assistance from finance. The person assisting us now has been inundated with her own workload, and we cannot wait for the reorganization and recruitment process to whet itself out before finding assistance. Already down by 70% FTE, we need to be able to offer a solution to quickly fill our manpower deficit and have someone assist us in processing essential mission requirements. (7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The price will be compared among similar types of services offered by GSA schedule contractors. These prices are already determined to be fair and reasonable. It is determined the price offered is the same offered under to most preferred commercial customers and is therefore fair and reasonable. (8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. Market research was not conducted at this time. The criticality of meeting our mission needs overrides the ability to conduct the type of market research necessary to acquire this service. This award was chosen to meet the immediate, impending need of acquisitions during an urgent, mission critical time. Future requirements will continue to be reviewed to meet similar requirements and determine if other organizations develop offering similar services. (9) Any other facts supporting the use of other than full and open competition: N/A (10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition. N/A (11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required. It is anticipated that the restriction of reorganization will be relieved within 8-10 months and new full time equivalents will be in place and hired. The overlap will be necessary only to ensure adequate training needs and the recruitment of full time staff. Future acquisitions are not anticipated. 12. Requirements Certification: I, Cindy M.
