Description
COMNAVSPECWARGRU-1 INSTRUCTION 3510.1 SOW for solicitation H92240-10-R-GM07 This is a combined solicitation for commercial services prepared in accordance with the format in FAR SUBPART 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items. This announcement constitutes the only solicitation;quotations are being requested and a written solicitation will not be issued. The solicitation H92240-10-R-GM07 is issued as a request for quotation (RFQ) and this is notice that NSWG-West Contracting Office, San Diego, CA intends to award a firm fixed price contract. The associated NAICS code is 611699 and the Small Business Size Standard is $7.0M. This is a small business set aside. Contract Line Item 0001. 1 LOT SIDE BY SIDE, LIGHTWEIGHT TATICAL ALL TERRAIN VEHICLE (LTATV) BAISC COURSE OF INTSTRUCTION (COI), ADVANCE LTATV NAVIGATION AND TERRIAIN ASSOCIATION COI, AND LTATV MECHANIC COI. ALL REQUIREMENTS ARE TO BE IN ACCORDANCE WITH THE STATEMENT OF WORK (SOW). SOW is attached Note: Vendors must be registered in the Central Contractor Registration (CCR) system to be considered for award. Registration can be completed online at http://www.ccr.gov The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-40. Offerors are required to complete and include a copy of far 52.212-3 with their proposals. Representations and Certifications shall be completed via the ORCA website https://orca.bpn.gov. The following provisions and clauses apply to this acquisition: 52.212-2 Evaluation—Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technically Accepted Past Performance Price Technical and past performance, when combined, is more significantly more important when compared to price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of provision) EMERGENCY MEDICAL SERVICES Emergency medical services will be provided by the contractor. NSWG-ONE will review planned emergency action plan and inform the contractor of any required improvements. LIABILITY CLAUSE If Navy personnel allegedly cause property damage, personal injury, or death to company property or personnel, the company or employee may file a claim with the United States Navy pursuant to either the Federal Tort Claims Act (28 U.S.C. 1346 (b), 2671-2672, and 2674-2680), or the Military Claims Act (10 U.S.C. 2733). In the unlikely event Navy personnel allegedly cause property damage, personal injury, or death to a third party, the third party may file a claim with the United States Navy pursuant to either the Federal Torts Claims Act (28 U.S.C. 1346 (b), 2671-2672, and 2674-2680) or the Mitary Claims Act (10 U.S.C. 2733). Naval Special Warfare Group ONE will facilitate the initiation of such claims by providing the necessary filing form and contact information for the Claims Processing Office at 9620 Maryland Avenue, Suite 100 Norfolk, VA 23511. In no case will government liability exceed that allowable under the Federal Tort Claims Act or Military Claims Act. USSOCOM FAR SUPPLEMENT 5652.209-9002 Use of Contractor Support/Advisory Personnel for Review of Proposals (2005) The offeror’s attention is directed to the fact that contractor consultant/advisors to the Government will review and provide support during proposal evaluations. When appropriate, non-government advisors may have access to offeror’s proposals and may be utilized to objectively review a proposal in a particular functional area and provide comments and recommendations to the Government’s decision makers. They may not establish final assessments of risk, rate or rank offerors’ proposals. All advisors shall comply with procurement Integrity Laws and shall sign Non-Disclosure and Rules of Conduct/Conflict of Interest statements. The Government shall take into consideration requirements for avoiding conflicts of interest and ensure advisors comply with safeguarding source selection and proprietary data. Submission of proposal in response to the solicitation constitutes approval to release the proposal to Government Support Contractors. USSOCOM FAR SUPPLEMENT 5652.209-9003 Use of Contractor Support/Advisory Personnel as Contract Specialists (2006) The contractor’s attention is directed to the fact that contractor personnel may assist the Government in a contract administrator role for administration of this contract.
