Description
February 9, 2010 JUSTIFICATION FOR OTHER THEN FULL AND OPEN COMPETITION 1. Agency: South Texas Veterans Health Care System (STVHCS), Audie L. Murphy Division and the VISN 17 Contracting Office (10N17/671C), 7400 Merton Minter, San Antonio, TX 78229. 2. Description of Action: This justification and approval is for the procurement of non-personal services from HearUSA to provide audiology services for the selected population authorized by the VA Medical Center. These services have been provided under contract number V671-P4158. All options to extend the term of the contract and extension of services have been utilized. An interim contract is being awarded to HearUSA to allow time for the re-compete process and contract award. The interim will ensure that services continue without out disruption to patient care. The term of the interim contract will be six months, with an option to extend for six months. 3. Description of Service: Contractor shall provide health care providers, medical facilities, medical and other equipment, supplies, and supervision necessary to create, implement and administer audiology and hearing aid dispensing services to meet the specific medical needs of the Veteran. The Contractor shall be responsible for management of all aspects of the contract. 4. Authority: A purchase contract will be issued to HearUSA in accordance with 41 USC 253 (c) (2); 6.302-2, Unusual and Compelling Urgency; 5. Proposed Contractor's Unique Capabilities: HearUSA is a recognized leader in hearing care and has more than 180 Hearing Care Centers nationwide in addition to nearly 2,000 independently practicing audiologists affiliated with the Hearing Care Network. HearUSA has provided audiology services to the South Texas Veterans Health Care System and are familiar with the computer system, patients, and have provided an acceptable level of care to patients. HearUSA will be able to assume the workload immediately maintaining the appropriate access to audiology services for Veterans. 6. Sources Sought Efforts: A long term contract is being pursued at this time. The action will be announced on FedBizOps to promote competition. 7. Determination of Price Reasonableness: It is anticipated that the negotiated cost to the Government for this procurement will be fair and reasonable based on previous negotiated pricing offered. 8. Market Research: There are no known contracts with the government. The National Acquisition Center Contract Catalog, and General Service Administration Advantage! websites were viewed with zero results being obtained. 9. Other Facts: Recent eligibility reform through the Department of Veterans Affairs has created a significant number of Veterans within the STVHCS's service area who are eligible for audiology and hearing aid prosthetics. Patient consult numbers have increased from approximately 25 consults in August 2008 to 250 in August 09. To disrupt service will be a disservice to the Veteran. HearUSA is a large company, registered in CCR and not on debarred listings. I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
