Description
In accordance with Federal Acquisition Regulation (FAR) Part 6, Other That Full and Open Competition, FAR 6.302-2 Unusual and compelling urgency, the United States Environmental Protection Agency, Region 2 intends to modify Contract No. EP-W-04-055 with AECOM Technical Services, Inc., for continuation of existing environmental cleanup services and emergency environmental cleanup response services in support of Region 2's emergency and rapid response program at sites of release or threatened release of hazardous substances under the Comprehensive Environmental Response Compensation and Liability Act of 1980 (CERCLA); the Robert T. Stafford Natural Disaster Act and pursuant to the Federal Response Plan. These services cover sites in New York, and New Jersey. The planned contract action represents a six-month "new work" extension of the contract, effective March 27, 2010 through September 26, 2010. The modification is necessary in order to ensure continuity of critical environmental cleanups services at existing sites and to have the ability to respond to an emergency environmental cleanup within 6 hours of receiving an emergency response notification. Award of the contracts resulting from solicitation PR-R2-08-10085 has been delayed, which has necessitated that the above existing contract be extended until these awards can be made. Region 2's requirements to be covered by this extension include any actions required to mitigate or eliminate any hazard or damage to the environment resulting from: a release or threat of release of oil, petroleum products, hazardous substances, pollutants or contaminants into the environment; the threat of fire and explosion and incidents involving terrorist acts, weapons of mass destruction and nuclear, biological or chemical incidents; or natural or man-made disasters. In addition to emergency environmental responses, should they arise; the work to be extended represents 13 existing task orders under Contract EP-W-04-055. These on-going environmental cleanup services require uninterrupted support in order to address and reduce immediate risks to human health and the environment. It is in the best interest of the Government to extend the existing contract pending award of the follow-on contracts, which are currently under evaluation. This notice is not a request for proposals. A determination not to compete this proposed procurement based on response to this notice is solely within the discretion of the Government.
