- Justification for Other than Full and Open Competition (Draft) Illumina Brand Reagents and Consumables The reference number for this notice is NHLBI-PB(HG)-2010-052. THE NATIONAL INSTITUTES OF HEALTH (NIH), National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisition (OA), for the National Human Genome Research Institute (NHGRI) intends to negotiate and award a contract on a brand name only basis for reagents and consumables manufactured by Illumina, Inc., 9885 Towne Centre Drive, San Diego, CA 92121-1975. The contract will provide for the purchase of all commercially available Illumina manufactured reagents and consumables. The reagents and consumables will be used specifically on the Illumina manufactured government-owned Genome Analyzers, BeadArray Systems, BeadXpress Systems, Cluster Stations and other genomic sequencing systems. A multi-year, indefinite delivery requirements’ type contract with fixed unit prices is planned. The period of performance is July 1, 2010 through June 30, 2015. Approximately $5 Million per year is expected to be expended for the purchase of Illumina brand reagents and consumables. The acquisition will be conducted in accordance with FAR Part 15--Contracting by Negotiation and the resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular 2005-38. The intended procurement will be classified under North American Industry Classification System (NAICS) Code 334516 – Analytical Laboratory Instrument Manufacturing, Size Standard of 500 employees. It is the intent to procure this supply contract by Other Than Full and Open Competition, specifically brand name only, pursuant to the acquisition authority set forth in FAR 6.302-1 -"Only Responsible source and no other supplies or services will satisfy agency requirements (brand-name)"and 41 U.S.C. 253(c)(1). This notice of intent is not a request for competitive proposals. Interested parties may identify their interest and capability in response to this notice within fifteen (15) days after publication of this notice. Responses to this notice must provide either (1) a letter of commitment from the manufacturer which will assure the offeror of a source of supply sufficient to satisfy the Government's requirements for the contract period, OR (2) evidence that the offeror will have an uninterrupted source of supply from which to satisfy the Government's requirements for the contract period. Upon approval of the Justification for Other Than Full and Open Competition, a request for proposal will be issued on an unrestricted basis. All responsible sources may submit a proposal which if timely received, shall be considered by the agency.
