- Bid Schedule Wage Determination Contractor Requirements Statement of Work This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and under the authority of FAR 13.1, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-38 dated December 10, 2009. The Government intends to make a Best Value award as the result of this solicitation, therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. The Government reserves the right to make an award to other than the low offer and/or make no award at all. This posting is to inform potential providers that the Environmental Protection Agency (EPA), Office of Radiation and Indoor Environments National Laboratory (R&IE) has a requirement for maintenance and repair of the Heating and Ventilation and Air Conditioning (HVAC) system for a Gravimetric Laboratory. See attachments for the Wage Determination, Statement of Work, Contractor Qualifications Requirements, and Bid Schedule. In accordance with FAR 19.502-2(a), this requirement is set aside for small business. The North American Industry Classification System code is 238220. The size standard is $14.0 million average annual receipts. The provisions in FAR 52.212-1, Instructions to Offerors-Commercial Items, are applicable to this solicitation. The provision in FAR 52.212-2 -- Evaluation -- Commercial Items is applicable to this solicitation as follows: Evaluation -- Commercial Items (Jan 1999) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Technical Capability, Past Performance, and Price. Technical Capability and past performance, when combined, are more important than price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) Past performance is defined as evidence of working a similar contract within the past three years. A similar contract is considered the repair, maintenance and control of Liebert systems deployed in very small, enclosed spaces. Offerors must submit point of contact name and phone number. As of 1 January 2005, offerors are required to complete online representations and certifications at http://orca.bpn.gov which are identical to what is required in FAR 52.212-3, Offeror Representations and Certifications-Commercial Items. In addition, the following clauses and provisions apply: FAR 52.212-4, Contractor Terms and Conditions-Commercial Items; FAR 52.204-7, Central Contractor Registration; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items with the following paragraphs checked as applicable: Paragraph (b) - (19), (21), (22), and (38); Paragraph (c) - (1) and (2). Wage Determination No. 2005-2331, Revision No. 8, Dated 07/15/2009 applies. THE RESPONSE DATE FOR THIS REQUEST FOR QUOTATION IS March 16, 2010, 3:30 PM Pacific Time. All offerors are responsible to confirm the successful transmission of electronic data. Late responses will not be considered. This announcement constitutes the only solicitation, which is issued as a Request for Quotation (RFQ); quotes are being requested and a written solicitation will not be issued. Questions regarding this acquisition must be submitted in writing, via email, pearlman.holly@epa.gov, no later than March 12, 2010, 3:30 PM Pacific Time. It is the offeror's responsibility to monitor this site for the release of amendments (if any). Potential offerors will be responsible for downloading their own copy of this notice, the on-line RFQ and amendments (if any). CCR Requirement - Company must be registered on Central Contractor Registration (CCR) before an award can be made to them. If company is not registered in CCR, they may do so by going to CCR web site at http://www.ccr.gov. The full text of a FAR clause may be accessed electronically at http://www.acqnet.gov/far.
